Leddy Jr., Chairman BOARD OF APPEALS TOWN OF NANTUCKET BOARD OF APPEALS NANTUCKET, MASSACHUSETTS 02554 March IS , 1984 DECISION: At a meeting of the BOARD OF APPEALS held on Friday, March 16, 1984 in the Town and County Building in the matter of the Application of ERNEST J. WEINHOLD JR. and NANCY T. ADAM (008-84), the BOARD finds: 1. This is an Application for relief by SPECIAL PERMIT as provided for under Section 4(:~B)(2)(b) of the Zoning By-Law. Under that Section photographer's studios are allowed by Special Permit as neighborhood service establishments. The premises are located at MILLBROOK ROAD and are zoned RESIDENTIAL. 2. At the outset, the Chairman, Andrew J. Leddy Jr., Esq., excused himself from sitting on this Application as the Applicants are his clients. Mr. Leddy stated to the BOARD that he had advised the Applicants to apply for a Special Permit because photographer's studios were specifically mentioned in the foregoing Section of the By-Law, but that he also believed that the use of their home in pursuit of their occupations as photographers was probably exempt from any need for special relief because it could be considered a home occupation. 3. Mr. Weinhold stated to this BOARD that he and Nancy T. Adam were artists in the photographic medium and wished to use a part of their home as a studio and darkroom. They would not be engaging in any retail sales of cameras, photographic supplies or the like and that their activities as photographic artists would generate no traffic burden, visual disturbance or anything else incompatible with the nature of the neighborhood. Based upon testimony and review of the application, supporting documents and the favorable recommendation of the Planning Board, the BOARD finds that the proposed use would be in harmony with the general purpose and intent of the By-Law. (008-84) -2- 4. For reasons set forth, the BOARD hereby GRANTS the Applicant a SPECIAL PERMIT under Section 4(B)(2)(b) of the Zoning By-Law, by UNANIMOUS vote. Dated: Nantucket, Mass.
