DECISION:
At a meeting of the BOARD OF APPEALS held on Friday, January 27,
1984 in the Town and County Building in the matter of the
Application of JOHN B. & COLEEN J. ARNO (005-84) the
BOARD finds:
1. This is an Application for relief by SPECIAL PERMIT for
a take-out ice cream establishment in a district zoned
LIMITED COMMERCIAL. In such districts, Section 4E(2)(c) and
(e) allow uses by Special Permit for retail businesses and
restaurants, respectively. Relief is also sought from the
intensity regulations of Section 5 of the Zoning By-Law.
2. Based upon a review of the Application, supporting documents
and plans, the unfavorable recommendation of the Planning Board
and testimony at the Hearing as to traffic congestion and
pedestrian hazards in the area of the proposed premises at
7 North Beach Street, a motion was made and duly seconded that
the proposed use would be in harmony with the general purposes
purposes ~nd'infi~ht o~ the By-Law and should be granted.
3. Two members of the BOARD voted AGAINST the motion and the
Application is thereby DENIED.

NOTICE
A Public Hearing of the BOARD OF APPEALS will be held on FRIDAY,
JANUARY 27, 1984 at 1:30 P.M. in the TOWN AND COUNTY BUILDING,
FEDERAL AND BROAD STREETS, NANTUCKET, on the Application of JOHN B.
and COLEEN J. ARNO (005-84) for relief by SPECIAL PERMIT from the
requirements of Sections 4(E)(2) (uses allowed by SPECIAL PERMIT) and
5(1) (Intensity Regulations) of the Zoning By-Law. If granted, the
Applicants would be allowed to add to an existing building and operate
a take-out ice cream business on the premises. The property is located
at 7 NORTH BEACH STREET and is zoned LIMITED COMMERCIAL.
