DECISION
At a meeting of the BOARD OF APPEALS held on 1~EDNESDAY,
AUGUST 31, 1983 in the Town and County Building in th• matter
of the application of ROBERT A. and CARLA G. FINN (39-83), the
BOARD finds:
1. This is an application for a SPECIAL PERMIT under Section 5.3
of the Zoning By-Law for relief from the setback requirements
of Section 5.3 of the Zoning By-law. The property is zoned R-2.
2. Based upon review of th• application, supporting documents,
plena end testimony at Public Hearing and a view of the site,
the Board finds that the dwelling situated at Meadow Uiew Driv•
Lot 11, LC Plan 35397, Assessor's sheet 56 parcel 169.3 is
aproximately ?.6 feet from the sideline of the property, whereas
the setback repuired by th• Byelaw is 10 feet. The property is
abutted on the side in question by unimproved land end not
distinguished by any natural features. The BOARD can only con-
clude that the violation occurred by error. In light of all
the factors considered, the 9CARD finds that permitting a
satt~ack of ?.6 ~fet (approximately) would be in har~aony with
with the general purpose and Intent of the By-law.
3. Fcr the reasons sat forth, the BOARD hereby ORAVTS the
applicant A Special Per~+it under Section S.3 of the Zoning
By-Lew ( Setback.raquiersrnents and relief therefrom in R-2
Districts) reducing the setback rsquirernent for the Applicantfl'
dwelling only to five(5) feet, as provided by Section a.3 of
the Zoning 8y-la+r, by unanimous vote.
