Dale , Cha irrnan NANTUCKET BOARD OF APPEALS BOARD OF APPEALS Nantucket, Massachusetts DECISION: At a meeting of the BOARD OF APPEALS held on Friday, January 7, 1983, in the Town and County Building;, in the matter of FRANKLYN DEMARCO (038-82), the BOAR) finds: 1. This is an application for a variance from Sections 5.3 and 6E of the Zoning By-Law in order to construct a thixty-six foot high dwelling at 32 Orange Street. 2. Based on review of the application, supporting documents and testimony at Public Hearing, the BOARD finds that the applicant has failed to establish specific circumstances affecting the subject property but not affecting generally property in the RESID~:NTIAL~OLD HISTORIC DISTRICT that would cause literal enforcement of height restrictions and side lot line setback requirements in this case to create substantial hardship for the applicant, that a dwelling in compliance with height restrictions and side lot set back require- ments could be built on the subject property, and that conformity with similar residential heights and this historic character of the neighborhood by themselves, do not support the issuance of a variance. 3. For the reasons set forth, the BOARD hereby DENIES the applicant a variance waiving the height restrictions and side lot line setback requirements in this case, by unanimous vote. ~30ARD OF APPEALS 7" Dated: Nantucket, i~?as~.
