Dale, Chairman NANTUCKET BOARD OF APPEALS J BOAR) OF APPEALS Nantucket, i~lassachusetts DECISION: At a meeting of the 30ARD OF APPEALS held on Friday, January 7, 1983, in the Town and County Building, in the matter of the application of PETER MEERBERGF,N (037-8?_), the BOARD finds: 1. This is an application for relief from Section 7-I-4 of the Zoning By-Law so that two prior, non-conforming lots situate on Jest York Lane, which were merged into single ownership and. thereby a single, conforming lot; may revert to separate, non- conforming lots. 2. Based on review of the application, supporting documents and testimor:y at Public Hearing, the BOARD finds that the applicant owns one nor-conforming lot situate at `nest York Lane individually {Lot 9). A contiguous, non-conforming lot (Lot 8) was, through an inadvertent .recording error, conveyed to the applicant, individually, thereby merging Lots 8 and. q into a single, conforming lot for one minute on September 28, 1978. Immediately thereafter, ~;oth lots were conveyed to the applicant, individually, and to a corporation. This inadvertent recor,~iing error constitutes a special circumstance which would cause literal enforcement of Section 7-I-4 to impose a substantial hardship upon the applicant by depriving him of a separate building lot, and relief may be granted without nullifying the intent of this Section. 3. For the reasons set forth the BOARD hereby GRANTS the applicant a variance relieving him from the provisions of Section 7-I-4 in respect of Lots 8 and 9, by unanimous vote. The lot on which the dwelling is to be constructed does not meet the minimum area requirmentts of the Zoning By-Law. Also it has come to my attention that the lot was held in common ownership with a contiguous lot through an ill-timed transfer of deeds. This act in essence welded the contiguous lots into one for zoning purposes. To resolve the matter you may request relief from my decision from the Zoning Board of Appeals. The record- ing of the deed of September 28, 1978 (Doc. No. 19993) transferring Lot 8 to you was an inadvertant and untimely registration of a deed that was prepared but was not to be recorded. The intention was to transfer Lot 8 directly from the Bank as Trustee into your corporation. The deed should not have been recorded, and it was not the intent o~ the parties to join contiguous non-con-- forming lots into a single ownership.
