DECISION:
At a meeting of the BOARD OF APPEALS held
on Friday, Jamaary 7, 1983, in the Town
and County Building, in the matter of the
application of B & N DISTRIBUTING CO.
(o36-8z), the BOARD finds:
1. This is an application for a use variance in order to
conduct a commercial interior warehouse facility for the storage
of bakery goods and bottles at the Navy Base in Tom Nevers.
2. Based on review of the application, supporting documents
and testimony at Public Hearing, the BOARD finds that the subject
premises are zoned LUC-3, that the proposed commercial use is not
permitted in the LUC-3 zoning district, that the applicant has
failed to establish specific circumstances relating to its proposed
use for this particular property that do not affect generaJ.ly
property in the LUC-3 district, that the proper- party to seek
relief from this Board is the Town of Nantucket, and that the denial
of the requested relief will not cause a substantial hardship to the
applicant since the proposed use is permitted in other Nantucket
zoning districts and the applicant has not shown that permitted
locations for the proposed use are unavailable.
3. For the reasons set forth, the BOARD hereby DENIES the
applicant a use variance to conduct a commercial wa-rehouse at the
Navy Base, by unanimous vote.

TOWN AND COUNTY BUILDING, Federal ant Broad Streets,
Nantucket, on the application of LAWSON BILLINGS, PRES.,
B & ;K DISTRIBUTING CO., INC., (036-82) seeking relief
from the provisions of SECTION 4-A-1 of the Zoning
By-Law in order to operate a commercial storage
facility. Property is located at the old NAVY SASE,
TOrI NEVERS and is zoned LUG-3.
