DECISION:
At a meeti~ of the BOARD OF APPEALS held
on Friday, January 7, 1983, in the Town
and County Building, in the matter of the
application of NANCY GARES (030-82), the
BOARD finis:
1. This is an application for a variance from the ground cover
ratio restriction and side lot line restriction of the Zoning By-Law
in order to expand an existing bedroom and to construct a bathroom on
the applicant's residence on Monamoy Road.
2. Based. on review of the application, supporting documents and
testimony at Public Hearing, the BOARD finds that the applicant has
failed to establish specific circumstances affecting the subject
premises but not affecting generally the LUG-l District to show that
literal enforcement of Sections 5.1 and 5.3 of the Zoning By-Law would
cause her a substantial hardship in this case.
3. For the reasons set forth, the BOARD hereby DENI3S the
applicant a variance from Sections 5.1 and 5.3 of the Zoning By-Law,
by unanimous vote.
