DECISION:
At a meeting of the BOARD OF APPEALS held on
Friday, November 19, 1982, in the Town anti
County Building, in the matter of the applica-
tion ~~f FRANCO MENSINI and ANN MENSINI (02~-82),
the BOARD finds:
1. This is an application to relocate and reconstruct
a pre-existing, non-conforming garage structure situate on
the applicants' property at 108 Main Street.
2. Based on review of the application, supporting
documents, testimony at Public Hearing and a site view of
the subject garage, the BOARD finds that the structure has
been a garage use prior to the enactment of the Nantucket
Zoning By-Law and is dilapitated, and the proposed
reconstruction and relocation of the garage will not be
more substantially detrimental to the neighborhood than the
existing non-conforming use. Further, the proposed recon-
struction and relocation of the garage will enhance the
neighborhood.
3. For the reasons set forth, the BOARD hereby
GRANTS the applicant a Special Permit for the proposed
reconstruction and relocation in accordance with Section
7 I (1) of the Zoning By-Law and waives Section 5(3) side
lot line set back requirements on the express condition
that the proposed garage not be used for dwelling purposes,
by unanimous vote.
