This is an application. for the Board's detem:ination cf the
applicability of Article 26 (Island Perimeter Restr cr_ior.) , a
1982 Amendment to the Zoning By-Law, to Lut 44-49, Wau~,~inet,
Nantucket, Massachusetts. The di.st.rict is zoned LUC-3.
The Board finds that the Nantucket Planning Board approved and;
endorsed a plan for the subiect property (Land Court Plan No.
10990C, Certificate No. 4737) on ceptember 7, 1°75. After I~
protracted litigation, the Nantucket Planning Board endc,rsec~ ~
"Approval Not Required" on similar plan of the subiect I ropert~
on October 27, 1A80. Article 26 (Island Perimeter Eestr;cti.or
became effective after these actions by the Planning Boar'
with respect to the plans at issue.
3. For the reasons set forth, the Board finds that Article
(Island Perimeter Restriction) , a 1982 Au end~rent to the
r;antuckzt Zoning By-Law, i.s NUT applicable to Lut 44-y9
October 27, 1983, pursuant to ~7I, Paragraph 8, of said

Gentlemen:
The above-referenced property is subject to a Purchase
and Sale Agreement with Catherine M. Conover. She and her
advisors, George M. Dallas of Gaston Snow and Ely Bartlett,
Travis Price of Price and Partners, Architects and Joseph
Marcklinger of J. Marcklinger and Associates are authorized
to submit applications before the various boards and commissions
of Nantucket for authority to develop one single family house
on the property.
