DECI~IUN:
At a meeting of the BUARD, OF APPEALc held
Friday, September 3, 1982, in the Town and
County Building., in the matter of the
application of DR. EDMUr'D McNALLY (022-8?),
after due deliberation, the BUARD found:
1. This is an application far a variance from §4AlC (set_back
requirements) of the Zoning By-Law. The applicant seeks to
construct a garage/apartment on his iroperty situate un
Meadowvieca Drive. The district is zoned RE~IrENTIAL 2.
2. The Board finds that due to the peculiar shape of the
applicant's lot, this construction of a garage/apartr:~ent
E;resents the applicant with cor,ditior.s particularly effecting
his property which do not effect other p roi;erty in the same
district. A literal enforcement of the Zoning By-Law in this
case would involve substantial hardship to the applicant and
the waiver of §4A1C setback requirements may be € ranted c~~ith-
out substantial detriment to the public goad and caithout
substantially derogating from the int_ereGt and spirit of the
7,oning By-Law.
3. For the reasons set forth, the Board finds that the relief 'i
requested may be granted because of conditions F,articularly '~,
effecting this prof>erty which do not generally effect other
property in this district, and substantial hardship to the 'i
applicant if the requested relief is not granted. The variance)
from §4A1.C of the 7_oning By-Lac•1 (setback reauirerr~er.ts) i s
GRANTED, in accordance with plans submitted, by unanimous
vote, upon the express condition that the aE~plicant Preserve
existing trees on the property, wherever possible, and the
garage doors face the proposed McNally primary cwe7ling, if
practical.
