County Building., in the matter of the
application of DA~~ID BRANSCUMBE and RICHARD
BRANSCUMBE, TRUSTEES OF RAND TRUST (019-82),
after due deli berat.i~n, the Board found:
1. This is an application to convert a two-family dwe]_l.ing at
17 Fair Street into a fi ve (5) ream guest house. The c'istrict
i.s zoned RESIDENTIAL/OLD HIS1'URIC. The applicant has sub-
mitted some evidence chat the property is a pre-ex~ sting ,
non-conforn~ing use.
2. The Board finds that the applicant's ~ntenti.on to alter a
two-family house to a guest house containing five roo,~,s for
rent constitutes an alteration of 17 Fair Street t_o a sub-
stantially greater extent than any prior use. ~;uch alteration'
is more detrimental than the existing non-conforming, use to
the neighborhood f_or the followi ng reasons : S nadequate
parking facilities, increased nui_ce problems associated with
increased number of guests, and increased traffic congestion '
in the neighborhood.
3. For the reasons set forth, the Board DENIES the relief
requested to alter and enlarge the nc,n-conforming use of 17
Fair Street in accordance with ~ecti.on 7I1_ of the Nantucket
Zoni_n€ By-Laws , by unanimous vote.

(010-77) in order to release Lot T (Farn.house Lut} from
conservation. restrictions ant to substitute a portion of Lot C!
or D i_n its ~71ace. The district is zoned LUG-2.
2. The Board f:.nds that Lot T is subject to cc,nservatic,n restric- i
Lions under prior S~,ecial Penr:it No. 010-77, more particularly
by covenants and restrictions listed in "'THE FARi~1 AT FISHERS
LAI~'DING DECLARATION OF EASEMENTS, CUVr.I~Aid'I'S, RESTRICTI:INS,
AGREEMENTS AIv'D CHANGES", a document filed with the pric,r
Special Perr;~it (010-77). This document states that the con-
servation land at Fisher's Landing shall be maintained as
scenic and conservation areas, that r,o conservation land can
be sold, ar:d that these covenants are nut subject to _nodifi-
catic;n with res~.ect to Cor.serva*.i~t; Lan.d. The applicant has
failed to designate specifically the portions of Lot C or
Lot D that wi.l.l be restricted for conservation ~.:ur~;oses.
3. For the reasons set forth, the Board finds that the relief
requested would be detrimental to neighboring landowners at
Fishers Landing ar.d such requested relief is exp ressl y f, ro-
hi_bited by documents filed e~~ith prior Special Permit (010-77).
Therefore, the Board hereby DENIES the appli.can.t a revision of
Special Permit No. 010-77, by ur.arimous vote.
