Decision:
~` At a meeting of the BOARD OF APPEALS held Wednesday,
~, June 30, 1982, at the Town and Cour_ty Building at 3:00
p.m., in the matter o.f the application of RON SHEPHERD
(017-82}, after due deliberation, the Board found:

1. This is an appeal from a decision of. the Building
~~ Inspector denying the Applicant a building permit
for a dwelling containing a home blacksmitt shop
'` located on Helen`s Drive and zoned RESIDENTIAL 2.
The Applicant has submitted detailed plans for this
property, which has been denied on the basis that
~~ th.e Applicant's activity is not a true home occupa-
tion.
2. The Applicant has presented evidence from which the
Board finds that this will be a two-story dwelling
with a lean-to shop for the blacksmith. There will
be no horses or welding work conducted and all
commercial activity will be indoors, consisting
principally of fabrication of sheet metal weather
vanes, hardware, and metallic objects. The neigh-
bors who are closest to this operation consider it
a benefit to their neighborhood.. The construction
of the building will enable the Applicant to keep
his activity indoors and, thus, add to the esthetic
value of the area.
3. The Board, therefore, finds and rules that the oper
tion of a home blacksmith shore under these conditio:
falls well. within the permitted use of a customary
home occupation.
4. For the reasons set forth, the appeal from the deci
sion of the Building Inspector is allowed and the
Building Inspector is hereby authorized to issue a
permit in accordance with plans submitted upon the
following conditions of the permit:
1) No retails sales are to be allowed on the pro-
per ty ;
2) There shall be no outside storag+~ or material o:
equipment; and
3) The grounds shall be properly screened by nativ
shrubbery or fencing to the satisfaction of the
Buildings Inspf~ctor.
