Mooney, Chairman NANTUCKET BOARD OF APPEALS BOARD OF APPEALS Nantucket, TRassachusetts Decision: At a meeting of the BOARD OF APPEALS held h~ednesday, June 30, 1982, in the Town a.nd County Building at 3:00 p.m., in the matter of the application of. DP.VID J. CARPENTER, ET iJX (014-82}, after due deliberation, the Board £-ound 1. This is an application for relief from the provi- sions of Sections 63 and 64 of the 7onina By-Law to' permit the use of a trailer for shelter during the construction of a residence located on Thurston's Way in an area zoned RESIDFPITIAL 2. The Applicants are the owners of_ the property and wish to utilize the trailer for relations assisting in the construc- tion of their house. A Violation Order was issued by the Building Inspector on May 13, 1982. 2. The Board notes that Section 6D prohibits the use of a trailer for residential purposes in all districts. The only exception is for a temporary office or shelter incidental to construction for a limited period. The Board interprets "shelter" to be a temporary protection and not a place of habitation, or a dwelling. We also find the spirit and intent of the Nantucket By-Law to forbid the use of trailer and mobile homes for residential purposes, and we are reluctant, in view of the volume of construction on the Island, to sanction any use of these vehicles for residential purposes. 3.
