County Building, in the matter of the

after due deliberation, the BUARD found:
1. This is an applicatic,n t_o extend a ~;rior. S~;ecial Permit issued
by the Board on June 30, 1981 for const:ructior, ~f a 35-lot
cluster subdivisivn.
2. The Bvard finds that the applicant has exerted substantial
efforts to commence construction. of this cluster subdivision
by filing pertinent plans with the Land Court, compl.etirg a
topographical r..ap and p.ercolatior. tests , securing. HDC
approval, staking, lots and putting out utility and road
constructi.cn for bid.
3. For the reasons set forth, the Bvard hereby GRANTS r_he
applicant an extension of Special Permit Na. 013-81 fir a
period up t~ and including December 31, 1982 ir, accurdar.ce
with Section 7F7 of the hantucker Zvni_ng By-Lac,,, by unanimous
vote.

Decision:
At a meeting of the BOARD OF P_PPEALS held V~ednesday,
June 30, 1982, in the Town and County Bui.ldina at 3:00
P.D4., in the matter of the application of RONALD M.
DA SILVA, after due deliberation, the Board found:
1. This is an applic~~tion for a Special Permit to con-
struct a garage as an addition to a dwelling house
located on Newtown Road in an area zones RESIDED?TIF:L
10. The Applicant has owned this property since '
1966 and proposes to construct the garage ~rithin
five feet (5') of the sideline requirement of the
common boundary.
2. The proposed construction requires a Special Permit
under the provisions of Section 5.3 of the Zoninc
By-Law which empowers the Board to grant a Special
Permit in this district. The Board finds that this
permit may be granted without detriment to the
nei:ghhorhood a.nd is in harmony with the general }?ur-
poses and intent of the By-Law.
3. Far the reasons set forth a Special Permit is rtrantecl
to permit the construction of a garage within five
feet (5' ) of the sideline by UNA~IIP-?OUS VOTE.
