DECISION
' At a meeting of the BOARD OF APPEALS held Friday,
December 18, 1981, at 3:00 p.m. in the Town and County
Building, in the matter of the petition of SHERBURNE
(ASSOCIATES (054-81), after due deliberation, the Board
found
1. This is an application for relief from the provision:
of Sections 7H, 6B, and 5 of the Zoning By-Law to permit
the reconstruction of a commercial building at 42-44 Main
Street in the Residential Commercial District of
Nantucket. The proposed building would replace a commer•
cial building razed for economic and esthetic reasons
by the owner and would have the same ground cover with
the addition of a second story for residential purposes.
2. This location is in the business district of Main
Street, where total ground cover and negative sideline
setbacks are compatible with the entire neighborhood. I:
addition, the majority of buildings have two story
construction and add to the harmony of the downtown
architecture. The entire neighborhood depends upon the
ample parking facilities of Main Street and no off-stree
parking area is available. The Board, theref ore, finds
the proposed construction is in conformity with the
purpose and intent of the by-law and the extension of
this pre-existing use will not be more detrimental than
the existing use to the neighborhood.
3. For the reasons set forth, the application for a
Special Permit to extend the existing use, by construc-
tion of a new building on the premises at 42-44 Main
Street, in accordance with plans submitted, is granted
by unanimous vote.

and COUNTY BUILDING, FEDERAL and BROAD STREETS,
NANTUCKET, on the application of SHERBURNE ASSOCIATES,
seeking relief from SECTION 7-H, 6-B, and 5 (floor
area, sideline, and setback requirements) of the Zoning
By-Law, in order to permit the expansion of the
existing non-conforming use by adding a second floor
and residential unit. Property is located at 42-44
MAIN STREET (shown as Lot No. 42.3.1 in Parcel 189),
and is zoned RESIDENTIAL/COMMERCIAL.

In the matter of the Petition of Sherb~~rne Associates re
premises at 42-44 Main Street:
The structure to be demolished and replaced is the buildinc?
known as the Camera Shop and the Kareka business. This structure
is on the parcel of land also occupied by the business known as
"The Sweet Shop".
The owner proposes to replace the Camera Shop-Kareka building
with a new building of the same ground cover dimensions but will
add a second floor to the structure.
