At a meeting of the Board of Pppeals held Friday, February 26, 1982,
at the Town ar~d County Building, in the matter of the application
of ISLAND H.OTEIS CCI"~'PNY (053-81) , after due delil-~xation, the
Board f ourxi
1. This is an application for a Special Permit to alter a non-
conforming use of property under SECTIOI\? 7H of the Zoning By-Law
and for relief fran the parking recxuiranents of the By-Law under
SECTIC~I 6B, plus a petition f or a variance f rem the sideyard
setback recluiranent of SEC'?'ION 5 of the By-Law. The property is
located on Easton Street, with a rear access on P~!ackey belay in an
area zoned Limited Carmercial.
2. The I~ppl icant Prot~ces t o r~~zr ~~n exi Est irxl hi~i lrl i rx~ which ha:~
been used for summer rental and anpl_oyee housing in conncection
with the PJhite Elephant Hotel operation. In its place would be
`erected two new buil_din:~s cont.ainirrt eleven 1.ivirxl units which
would be additional rentals for the hotel.. This is a ~~_rmitted use
in this district utxler a Special Pc~mit. The At~~~~licant has suh-
mitted aplan of the proposed construction ar~d larxlscaping which is
'filed herewith and marked "I?.'° The plan indicates prc~~~i5ion for.
six parking spaces of_f Mackey Dane, where~~s the normal recruir~nent
would be eleven parking spaces, and a sideline setback of 4 feet,
six inches, whereas the reciuired d:_i_stance is five feat.
3. The Board finds this property located in a district almost
totally devoted to summer rentals, 7'oaning houses, aril the U'hite
'Elephant Hotel eccnplex. Easton Street is a wide and heavily
!travelled public way. Placket' Lane is a marrow public way with
little traffic except that created by the abuttirxi owners. The
area is served by public water and sewer lines. The proposed use
is in conformity with the zoning of the area and the general
character of the neighborhood, aril the proposed structzzres aril larxl-
'scaping will be substantially more attractive than the existing
site location.
4. The Boazcl has explored the parking situation in connection with
hotel facilities in depth in several ot~lier cases, including the
Harbor House canplex. F'e are aware of the parking problems in
Town during the summer months. In view of the fact that many
visitors arrive by plane aryl many other. tr_~-3nsients do not require
'parking, we have concluded that a literal canpliance with the
parking rc~c~uiraments may be excessive, l;ut- scxne aclclitional off_-
street parking is necessary. Furtherniore, we find the Applicant
has the right to use Mackey Lane fc~r access and such use will afford
some relief to the traffic aril narking P~rc~blfsr~s on Talton Street .
5. We find the Applicant has net d«nonsisatc3:1 any a}~tutory
requirement for a hardship to justify the rec~uestc~a variance fran
the sideline setback reciuir~nent. 'Phe p_lar,s must }e revised to
include the necessary setback accordingly.
6. For the reasons set forth, the Board finds tt-~-_~t the proposed
alteration of the non-conforming use wil]_ not be substantially
more detrimental than the existing non-conformirx~ use to the
neighborhood, and the application to raze the existing lxailding arx~
replace it c>rith the new }xzildings containing eleven rental units
is GRArFI~D, subject to the condition that the ~~plicant revise its
plans to eliminate parking spaces on Mackey V~~ay arx~ direct its
guests to use the nearby White Elephant parking lot. The recruested
variance from the sideline setback requirement is DENIED. This
decision is by unanimous vote of the Board .

and COUNTY BUILDING, FEDEF.AL and BROAD STREETS,
NANTUCKET, on the application if ISLAND HOmEL COMPP_NY
seeking relief from SECTION 7-H (Revision of Non-
conforming Use), SECTION 5 (S ideyard setback require-
ments), and SECTION 6B (Parking requirements) of the
Zoning By-Law, in order to permit the razing and
replacement of the existing structure with like-use
structure of varied design. Property is located
on Easton Street, shown as Lot 2 in Plan Book 8,
Page 13 at the Nantucket Registry, and is zoned
LIMITED USE/COprMERCIAL.
