DECISION:
At a meeting of the BOARD OF APPEALS held Friday,
l! December 18, 1981, at 3:00 p.m. in the Town and County
Ii. Building, in the matter of the application of SHERBURNE
"~ ASSOCIATES ,(052-81), after due deliberation, the Board
~4 found:
1. This is an application seeking relief from the
provisions of the Zoning By-Law to extend a nonconform-
ing use of property on Somerset Road by permitting the
construction of dormitory units in a district zoned
Residential 2. The Applicant seeks to demolish an old
barn and replace it with a dormitory described as
"employee housing units" for 12 mixed individuals, plus;,
an apartment to provide housing for supervisory help.
2. The Board finds this location to be in a rural area
on the edge of Nantucket town, principally residential
~~ in nature, and served by a minimum of public facilities.
'~ The area is not served by public water supply, but
~~ relies upon private wells for potable water. Roberts
~! Lane is an unpaved dirt road. The present use of the
~' property has resulted in parking problems in the neigh-
°' borhood and noise complaints during the summer months.
In addition, the present by-law contains no provision
`' for establishments of apartments and none whatsoever for
dormitories. If there is a need for such property
!~ development, it must be authorized by the Town Meeting,
~~ not the Board of Appeals.
3. For the reasons set forth, the Board specifically
finds that the proposed extension of the non-conforming
use of the property on Somerset Road, shown on Land
Court Plan No. 37610-A, would be substantially more
detrimental to the neighborhood than is the existing
non-conf orming use, and the application is, therefore,
denied by unanimous vote.

and COUNTY BUILDING, FEDERAL and BROAD STREETS,
NANTUCKET, on the application of SHERBURNE ASSOCIATES
seeking relief from SECTION 7-H -EXTENSION OF A NON-
CONFORMING USE- of the Zoning By-Law, in order to
permit the razing and replacement of an existing
building with 3 dormitory units, plus one apartment,
in order to provide employee housing. Property is

In the matter of the petition of Sherburne Associates to the
Board of Appeals relative to premises on Somerset Road:
The locus is presently used as employee housing. There are
three structures on the property used (1) as a two unit dormitory
housing 6 persons per unit and (2) a three unit dormitory housing
6 persons per unit and (3) a barn.
The owner proposes to raze the barn and replace it with a two
story residential unit consisting of three units to be used as a
dormitory and housing 6 persons per unit plus a supervisors apart-
ment. Each of the units now has an efficiency kitchen. It is pro-
posed that each new unit have a similar efficiency kitchen.
The expansion is required to accomodate employee housing.
