Mooney, Chairman NANTUCKET BOARD OF APPEALS BOARD OF APPEALS Nantucket, Massachusetts b v z 0 v x 0 4a v a~ -.~ V .,., .,~ 3 ':Decision: At a meeting of the BOARD OF APPEALS held Friday, Decem- ber 18, 1981, at 3:00 p.m., in the Town and County Build- ing, in the matter of the application of WILLIAM WILLETT~`j (044-81), of ter due deliberation, the Board found: 1. This is an application for relief from the setback requirements of SECTION 4Ac.1 of the Zoning By-Law to eliminate the requirements for a 12 ft. setback between ~ the principal dwelling and the secondary dwelling of the lot at 27 North Liberty Street in a district zoned RESIDENTIAL - OLD HISTORIC. The Applicant seeks to build the secondary garage and dwelling on the front line of the lot. The reason for this unusual procedure is the ~ presence of a wetlands area known as Lily Pond, which extends into the rear of the lot itself and would, there- fore, endanger the stability of a foundation. 2. The Board finds that this property is located on a residential street extending into a marsh area which at times has standing water within 20 ft. of the normal setback line. The only suitable building area is along the North Liberty Street frontage of the lot. The purpose of the by-law provision for a 12 ft. setback is to preserve the open spaces and prevent construction of dwellings within 12 f t. of each other. This requirement may be satisfied in this instance by locating the garage 12 ft. from the front line of the property in the side- yard of the principal dwelling. Such a location would not affect the wetlands to the rear of the dwelling and would preserve the open spaces in this neighborhood. Th Board interprets the intent of the by-law to permit this secondary dwelling so long as it is separated by at least 12 f t. from the principal dwelling, and this is th only manner in which it may be effected on this lot. 13. For the reasons set forth, the application for relief is granted with the provision that the secondary dwelling shall be constructed at least 12 ft. beyond the front building line of the property at 27 North Liberty Street and 12 f t. away from the closest wall of the principal dwelling by unanimous vote.
