DECISION
At a meeting of the BOI~Rn OF APPEALS held 4~]ednesday,
August 26, 1981, at 8:00 a~:zn., in the matter of the
application of ALAN H. W. SFiIFF (035-81) , after due
de.liberatian, the Board found:
1. This is an application for relief from the provision
of SECTION V-setback requirements of the Zoning By-Law t
permit the construction of an addition to a dwelling on
Starbuck Road in r~adaket. The Applicant bought the
property and built the house in 1968 when the zoning was
RESIDErITIAL 1 and the setback was twenty feet. The
zoning was upgraded in 1980 and the setback became
thirty feet. The proposed construction would come withi
twenty-two feet of the sideline.
2.. The Board finds this is a true case involving an
extension of the non-conforming aspects of this dwelling
under circumstances caherein the change in the zoning
district has created the nori-conformity. The proposed
expansion would not endanger. the public safety nor
neighbors' legitimate expectations of security.
Therefore, we find the proposed expansion of the non-
confirming use of the dwelling would not be more detri-
mental to the neighborhood than the existing use and may

3. I'or the reasons set forth, the application for a
special permit to extend the non-conforming use of the
property by construction of an addition up to twenty-two
feet from the sideline is granted, by unanimous vote.
