API'£AI~S Dlantucket, Plassachusetts Decision At a meeting of the BOARD OF F~PPEAIS held Wednesday, August 26, 1981, at 8:00 A.P9., in the matter of the application of r7arjorie Bartlett Colley (034-81), after due deliberation, the Board found: 1. This is an applir..ation for r_el.ief from SECTION V, sideline setback requirements, to permit the construction of a deck within the setback area of a lot, located in the rear of 14 Gardner Street. The dwelling has been constructed and occupied within the requirements of the by-1.aw, but the proposed deck will infringe upon the sideline, and wi.1_l, in fact, run .up t.o the sideline of the property. ~ 2. Although the Applicant claims the addition of the dick would serve to eliminate a depression in the prope and avoid construction of a retaining wall, we cannot justify this addition without:. doing violence to the :intent of the zoning by-law. There can be no intrusion upon the sideline set.bar..k area without proof .of a hard- ship sufficient to justify a variance. We find no scuh har~jship as req~.ii.red by the ~;tatute. 3. For the reasons set forth, the application is by unanimous vote.
