Any appeals from this action shall be made pursuant to Section 17 of Chapter 40A of the General Laws, and shall be filed within twenty (20) days after this date. ~`ic~'~-~ Robert F. Moons Chairman Y~ ~ (~ ~ ~~~ 1 ~ Z:, 5'U NANTUCKET BOARD OF APPEALS ~~\ e - . ~~ ~~~ BOARD OF APPF7~LS Nantucket- , PRassachusetts Decision At a meeting of the BOARD OF AFPFAhS held Wednesday, August 26, 1981, at 8:00 A.M., in the matter of the application of MARSHALL and NANCY COX (033-81), after due deliberation, it was found: 1. This is an application for re]_ief from t of. SECTION V, sideline setback requirements, the construction of a bedroom addition to a nuidnet. The proposed addition would be 15' he provision to permit ' cottage in x 12' and would come within two feet. of the sideline of the property. The App]_icant claims i_t would not be visible ,; from the neighbors' proper.t.y and would amount to an extension of the non--conforming aspects of the present cottage. 2. The Board finds this property i_s located on nuidnet Road and has a land area of 1.136 acres. The cottage is located i.n the northwest corner. of the lot, close to the sideline. It has adequate room? for expansion in three other directions wit-bout violating the letter or spirit of the zoning by-law. The interests of the neighboring properties in privacy and safety require a finding that any expansion over the sideline setback would be more detrimental to the neighborhood than the existing structure. Furthermore, we find no hardship sufficient. to justify a variance from the requirements of the zoning by-l.aw. 3. I~'or the reasons set forth, the application is deniedi, by unanimous vote.
