";DECISION:
At a meeting of the BOARD OF APPEALS held Friday, May 8,
1981, at 3:00 p.m., in the Town and County Building, in
the matter of the application of F. DEN`~ON WERTZ (022-
81), after due deliberation, the Board found:
1. This is a petition for a variance from the intensity
regulation of Section V of the By-Law to permit the use
of a lot of 18,000 square feet area as a buildable lot
in an area zoned Residential II, which requires 20,000
square feet. The land is located in the Tristram Land-
ing section of P•4adaket in a booming residential develop-
ment. The land is shown as Lots 358 through 363 on
Land Court Plan 3092-22, which are restricted to use as
one lot on Land Court Certificate of Title No. 8742.
The Petitioner also owns abutting land shown as Lots
364 through 370, which is just sufficient to constitute
a 20,000 foot lot.
2. The Petitioner acquired this property in 1979, as a
result of a divorce settlement, after an original pur-
chase of the 13 lots in 1975. The original deed
restriction implies an intention that two "lots" were
being created, although the area conveyed was 2000 sa.
feet short of the required area. The resulting hardship
to the Petitioner consists solely of the face he is
left with one building lot instead of two, which may
result in some financial loss in the event of. sale. We
do not find, however, that such a situation satisfies
the statutory requirements for a hardship sufficient to
grant a variance.
3. For the reasons set forth, the petition for a
variance from the intensity regulations is denied, by
unanimous vote.
