Mooney, Chairman NANTUCKET BOARD OF APPEALS BOARD CF APPEALS Nantucket, Massachusetts '' DECISION: At a meeting of the BClARD C~ APPEALS held ~iday, N',ay 8, 1981, at 3:00 p.m. in the Town arx3 County Building, in the matter of the application of ROGER CAtt[JSO (017-81) , after due deliberation, the Board found: 1. This is an application far relief from the provisions of Section V, road frontage, of the Zoning By-Law to permit the Applicant to raze and reconstruct a ~ivate dwelling house far 'personal use on a private right-of-sway located Off Washington St. in an area zoned Residential/Cannescial. The lot in ctwestion is Lot 2 on Land Court Plan No. 10710-H, arx3 presently contains a dilapidated cranberry shack which the Petitioner intends to pur- chase, raze, and reconstruct as an attractive private home. The lot itself contains 5158 square feet of land, more than the minimun required, and is serviced by a 20-foot wide easement road ar driveway fran hTash.ington Street. The only non-conformity of the lot is the lack of an approved access road to Washington Street. 2. The Board finds this property located in a fully developed residential and ca~ercial area. It is clear the property has been subdivided under the provisions of Chapter 41, Section 8~, permitting the separate buildings to be conveyed because they existed prior to the Zoning By-Law. The present building is an unsightly structure of ancient vintage grid the proposed new con- struction would greatly improve the appearance of the entire neighborhood. The Building Inspectar, however, cannot grant a building permit for the new building because the lot does not have frontage on an approved road, hence this appeal. 3. In the opinion of the Board, the proposed use and construction on Lot 2 is in conformity with the general purpose and intent of the by-law, and the existing easement over the 20-foot driveway is adequate for a private residential dwelling. The Board, therefare, finds ar~d rules that the Building Inspector may issue a building peiznit for. razing the existing structure and construction of a private residential dwelling on I,ot 2, Larxi Court Plan PJo. 10710-H, in accordance with the plans suYmitted.
