Mooney, Chairman N1~NTUCKFT BOARD OF APPEALS BC?ARD OF APPEALS Nantucket, N'assachusetts DECISIC~: ' At a meeting of the EQARD GE' APPFAT~S he]~1 Friday, April 10, 1981, in the TOWN AND COL?N!'Y BUILDING at 3:00, p.m, in the matter of the application of JOAN G. B(XTL'H (012-81), after due deliberation, the Board found: 1. This is an application far relief from the rear line setback provisions of SECTIC~T 5.3 of the fay-I,~~aw to permit the construction of a deck addition to a cottage on Easton Street in an area zoned '~ Limited CcYmrercial. The construction having been done, the Board ~'~ viewed the area. The construction. consists of a small secorxl- story deck or porch serving a secondary dwelling in the backyard of the Easton Street property. The deck overlooks the rear of the Harbor House complex acrd the immediately adjacent area is a parking lot. Although the deck canes very close to the lot line, it does not impair or effect any adjoining structure or use. 2. The Board finds this is a case ~,rhexe no hardship has been established sufficient to justify a variance. Although there i.s a technical violation of tre lot line setback reruixements, we find the intrusion is minimal, and we, therefore, in the absence of any objections frcgn the neighbors, will c*rant a Special Permit to maintain the deck in its present place. 3. Far the reasons set forth, the Board grants the application for a Special Permit to maintain the existing deck fh' unanimous vote .
