BOARD OF APPEALS which has this day been filed with
the Town Clerk.
Any appeals from this action shall be made pursuant
to Section 17 of Chapter 40A of the General Laws,
and shall be filed within twenty (20) days after
this date.

At a regular meeting of the BOARD OF APPEALS held
Friday, April 10, 1981, at 3:00 p.m, in the Town and
County Building, in the matter of the application of
BERTHA ARNOLD (009-81), after due deliberation, the
Board found:
1. This is an application for some relief from
the die-line requirement of the By-Law to permit the
construction of a garage on Lots 86 and 95 in Madaket
which will come within four feet of tYie sideline. The
garage is 16' x 24' and will not exceed the allowable
ground cover. The neighbor most concerned concerned
does not object and the Planning Board favors this
application. The Board finds no substantial violation
of the intent of the By-Law in this case, and favors
the proposed construction as a matter of public policy
in this neighborhood. It will rec~uir.e a setback of
six feet from the sideline as a matter of. fairness.
2. For the reasons set forth, the Board rules
the Building Permit should be issued by the Building
Inspector, 6 feet from the sideline, by unanimous vote.

on FRIDAY, MARCH 27, 1981, at 3:00 P.M. at the TOWN
AND COUNTY BUILDING, FEDERAL AND BROAD STREETS, NANTUCKET,
on the Petition of BERTHA G. ARNOLD seeking relief from
the provisions of SECTION 5, INTENSIFY REGULATIONS of the
Zoning By-Law to permit the construction of a garage.
The property is located in Madaket, Lot 86 and 95, Land
Court Plan No. 3092-R, and is zoned RESIDENTIAL 2.
