DECISION:
At a regular meeting of the BOARD OF APPEALS held on
February 25, 1981, at 3:00 P.M. at th.e TO[~?N P.ND COUNTY
BUILDING, in the matter of the application of CHRISTOPHER
j WALTON (004-81), after due deliberation, the Eoard found:
1. This is an application for a variance from the
requirements of Section 5, GROUND OVERAGE, for property
located on Washington Street in Madaket in an area zoned'
RESIDENTIAL 2. The Applicant purchase this property in '
December of 1980. The lots contains 4,000 square feet
in an area zoned for 20,000 square feet minimum area.
It contains an existing cottage, and to this the Appli-
cant would like to add a 12' x 14' bedroom having an
area of 168 square feet.
j2. We find this to be another instance of an attempted
;expansion of a building on a non-conforming lot. Such
!an expansion requires a finding that a hardship exists
;which is unique to this property. We do not .find this
j; case satisfies the statutory requirements f_or finding a
'hardship.
`; 3. For the reasons set forth, the application for a
variance is denied by unanimous vote.
