Robert F. Mooney, Chairman NANTUCKET BOARD OF APPEALS ~~ BOARD OF APPEALS Nantucket, Massachusetts nF~ISZ~N- At a regular meeting of the BOARD OF APPEALS held on February 25, 1981, at 3:00 P.M. at the TOW1~I AND COUNTY BUILDING, in the matter of ROSLYN RF.TNER. (003-81), after due deliberation, the Board found: 1. This is an application for relief under SECTION 4A- 1-B-2 to permit a secondary dwelling on property located. on Sheep Pond Road in a district zoned LIMITED USF GENERAL 2. The unit has been constructed but according I to the Applicant has not been occupied. It is attached to the main house, but due to an error in construction, is located only 9.5 feet .from th.e rear of the house instead of the rec?uired 12 feet. 2. The Board finds this property is located in a rural development in the Sheep Pond area. It was purchased in 1974 and construction was started after that date. The policy of the Zoning By-I~aw is to permit one principal dwelling, and, subject to th.e restrictions in Section 4A-1-B, a secondary dwelling. This unit will be the second and last dwelling unit on the property and there can be no other dwelling built on this lot. V~Je do not }treat this as a matter for a variance, as there is no (hardship established, but as an extension of a non- conforming use. As such, we .find that relief may be granted without substantial detriment to the neighbor- hood and without detracting from the purpose of the By- j Law. 3. For the reasons set forth, the application for approval of the existing unit on the property at Lot 7, Sheep Pond Road, as a secondary dwelling unit is granted by unanimous vote. ~~s-~~-a-~ ~ \ 1 ~'~ ~~ BOARD pF P.PPEALS L. ~ _ oa Q..,.... 1 1 ~~"~ J r~ ~ ~ ~ ' ( /' , f ~ "~ - _ ~ __ ~~ -~ -- _ - ~-~ Z• BOARD OF APPEALS A Public Hearing of the BOARD OF APPEALS will be held FRIDAY, FEBRI?ARY 13, 1981, at 3.00 F.M., at the TOWN AND COUNTY IIUILDING, FEDERAL and BROAD STREETS, NANTUCKET, on the application of ROSLYN G.
