Map 42.3.3 Parce1165-166 Residential -Old Historic 2 & 4 Vestal Street Deed Book 121, Page 365 NANTUCKET ZONING BOARD OF APPEALS DECISION: The Board of Appeals at a Public Hearing held on Friday, October 16, 1998, at 1:00 p.m. in the Conference Room of the Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, made the following Decision on the application (100-98) of MARIA MITCHELL ASSOCIATION, of 2 Vestal Street, Nantucket, Massachusetts 02554. 1. Applicant is seeking a SPECIAL PERMIT under Nantucket Zoning By-law Section 139-33A (alteration/expansion of apre-existing nonconforming use/ structure) and under Section 139-7D (Employer dormitory). Applicant wishes to demolish the existing building and construct in its place a new employer dormitory with office space that would be accessory to the Maria Mitchell's educational purposes. The existing structure contains a 6-person dormitory with other uses ancillary to the main campus on adjacent properties. The new structure would be two-story and house eight (8~ employees with first- floor office space and would comply in all respects with t e ground cover and setback requirements. The shed that is currently within the side yard setback would be demolished as a part of this project, thereby curing that nonconforming situation. Applicant also seeks a VARIANCE and a SPECIAL PERMIT under Nantucket Zoning By-law Section 139-18 (Parking requirements). The uses in the new structure would require eleven (11) spaces. Six (6~ parking spaces would be provided on site. Relief y Special Permit for 30%, or our (4), and Variance relief waiving one(1) would be required. The premises is located at 2 & 4 VESTAL STREET, Nantucket, Massachusetts, Assessor's Map 42.3.3, Parce1165-166. The Locus is zoned RESIDENTIAL -OLD HISTORIC. 2. The Board's decision is based upon the application and materials submitted with it, plans, and representations and testimony received at the hearing on October 16,1998. The Planning Board recommended that the requested relief be granted. 3. The Board finds that the proposed office use is consistent with and an integral part of the Applicant's educational purposes and educational programming. Accordingly, this use qualifies for the educational exemption under Chapter 40A, Section 3. 4. While the Planning Board noted that the educational exemption may also be applicable in the context of the Special Permit request for the Employer Dormitory, at the Applicant's request, the Board considered the proposal for a newly constructed and enlarged Employer Dormitory. The housing of Maria Mitchell Association interns on-site decreases the need for staff parking spaces. The integration of the dormitory facilities with the office and classroom space in the new building will help monitor resident activities. The existing building already houses six employees; the new building will provide improved, handicapped accessible living space for eight employees. The Board finds that the new dorm proposed is in harmony with the general purpose and intent of the Nantucket Zoning By-law and not substantially dnfferent from the existing dormitory use. The new building project will correct all dimensional non- conformities on the site. 5. With respect to the relief requested from the parking requirements, as in the Board's Decision with respect to Maria Mitchell Association's Hinchman House project on adjacent property (ZBA File No. 024-96), Applicant represented that Maria Mitchell Association's programs and facilities do not create a high demand for parking spaces given its location, as most patrons come to the facility by foot or bike, and the employees are discouraged from bringing cars. Many of the Association's activities are scheduled at off-site locations. Currently approximately six cars park in non-conforming parking spaces on the property. The site plan submitted would create a parking area for six cars; to create a larger parking area would sacrifice significant open space dedicated to gardens, mature trees, and dense hedges. Many members of the public who attended the hearings or submitted letters in connection with the Hinchman House project opposed dedicating significantly more of the Terrace Cottage property to additional parking uses than is currently provided. The Board agreed, finding that a significant increase in the parking areas beyond what currently exists would detract from the character of the neighborhood and be contrary to the intent and purpose of the Zoning By-law. The Board therefore finds that the provision of more than six parking spaces on the property would be detrimental to the neighborhood. The Applicant also established, and the Board finds, that the unique circumstances relating to Maria Mitchell's existing structures and their uses do not generally affect the zoning district; the literal enforcement of the parking requirements would prohibit this not-for-profit organization from pursuing its programs and improving its facilities thereby creating substantial hardship; and the project proposed could proceed without detriment to the public good and without nullifying or derogating from the intent or purpose of the Nantucket Zoning By-Law even if only the parking shown on the site plan attached as Exhibit A was provided. 6. Accordingly, based upon the foregoing findings, the Board hereby GRANTS by a unanimous vote, the requested SPECIAL PERMIT under Nantucket Zoning By-Law Section 139-33A and SECTION 139-7D to allow the demolition and construction of the proposed new employer dormitory and office building, and the requested SPECIAL PERMIT and VARIANCE from the parking requirements of Section 139-18, waiving five of the eleven parking spaces, on the following conditions: a) that the improvements be constructed substantially in accordance with the site plan prepared by Emack Surveying dated February 10,1998, revised September 26,1998 and November 12,1998, as approved by the Board and on file at the Board of Appeals, showing no less than six parking spaces; and b) that o~rtl~,employees of Maria Mitchell Association shall be housed in the dormitory permitted hereby. The Applicant also seeks, in the alternative, relief from the parking requirements of Section 139-18 by either VARIANCE or by SPECIAL PERMIT. The existing structure has contained a 6 person dormitory with other uses ancillary to Maria Mitchell's main campus on adjacent properties since it was acquired by the organization prior to 1972. A February 10,1998, site plan showing existing conditions drawn by Robert A. Emack, P.L.S. is included with this application. The existing building needs a new foundation, and a substantial reconfiguration of the interior space is needed so as to increase the occupancy of the building slightly and provide for handicap accessibility to both floors of the building. Accordingly, the Applicant proposes to demolish the existing structure and construct in its place the new 2-story building shown on the attached plans. The new building will house 8 employees, and office includes first floor office space ancillary to the organization's educational programming and a basement. The new building will comply in all respects with the ground cover and setback requirements. The shed that is currently within the side yard setback would be demolished as a part of this project, thereby curing that non-conforming situation. The existing structure has been serviced by the parking area shown on the Emack plan. While the area roughly the equivalent of four parking spaces as defined in the zoning code, more cars park in this area during the summer season as it is used by employees primarily. The uses in the structure (an 8 person dorm, 1,096 square feet of office space) result in a parking requirement of 11 spaces. The proposed parking plan shows 6 spaces, requiring the issuance of a Variance. In the alternative, the Applicant submits the enclosed 8 space parking plan and requests, if the variance relief is not granted, a waiver of 30% of the required parking by Special Permit pursuant to Section 139-18B. The Applicant would prefer the plan with a smaller parking area to preserve additional green space and trees on the lot. The Applicant also seeks, in the alternative, relief from the parking requirements of Section 139-18 by either VARIANCE or by SPECIAL PERMIT. The existing structure has contained a 6 person dormitory with other uses ancillary to Maria Mitchell's main campus on adjacent properties since it was acquired by the organization prior to 1972. A February 10,1998, site plan showing existing conditions drawn by Robert A. Emack, P.L.S. is included with this application. The existing building needs a new foundation, and a substantial reconfiguration of the interior space is needed so as to increase the occupancy of the building slightly and provide for handicap accessibility to both floors of the building. Accordingly, the Applicant proposes to demolish the existing structure and construct in its place the new 2-story building shown on the attached plans. The new building will house 8 employees, and office includes first floor office space ancillary to the organization s educational programming and a basement. The new building will comply in all respects with the ground cover and setback requirements. The shed that is currently within the side yard setback would be demolished as a part of this project, thereby curing that non-conforming situation. The existing structure has been serviced by the parking area shown on the Emack plan. While the area roughly the equivalent of four parking spaces as defined in the zoning code, more cars park in this area during the summer season as it is used by employees primarily. The uses in the structure (an 8 person dorm, 1,096 square feet of office space) result in a parking requirement of 11 spaces. The proposed parking plan shows 6 spaces, requiring the issuance of a Variance. In the alternative, the Applicant submits the enclosed 8 space parking plan and requests, if the variance relief is not granted, a waiver of 30% of the required parking by Special Permit pursuant to Section 139-18B. The Applicant would prefer the plan with a smaller parking area to preserve additional green space and trees on the lot.
