DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Wednesday, December 4, 1998, at 10:00 A.M., in the
Conference Room,. in the Town Building Annex, 37 Washington
Street, Nantucket, Massachusetts, the Board made the following
decision on the application of PILOT WHALE NOMINEE TRUST (Keith
M. Yankow, Trustee), c/o Reade, Gullicksen, Hanley & Gifford,
LLP, Post Office Box 2669, Nantucket, Massachusetts 02584, File
No. 093-98 (originally noticed for September 11, 1998, and
continued over the course of several meetings until December 4,
1998)
2. The Applicant proposes to construct a duplex building
which will be used as an employer dormitory, for which the
Applicant is seeking Special Permit relief under Nantucket Zoning
By-law §139-7.D(4) On the basis of a maximum of twenty-four
occupants in the employer dormitory, thirteen parking spaces are
required for this use. The Applicant will provide up to seven
parking spaces on the subject property. Accordingly, Special
Permit relief is being sought under Nantucket Zoning By-law
~139.18.B(4) to waive up to 30a (four) of the required parking
spaces, and a Variance from the parking requirements of §139-18
to waive two additional parking spaces. In addition, and to the
extent necessary, the Applicant is seeking Variance relief from
the requirements of §139-19 as they relate to screening and
driveway width. (See all companion Board of Appeals files, Nos.
085-98 through 093-98, inclusive.) The subject property (the
"Locus") is situated at 14 PILOT WHALE DRIVE, Assessor's Map 67,
Parcel 398, Land Court Plan 26439-0, Lot 67, and is zoned as
Residential-10. (At the hearing, the Applicant presented a
modified subdivision plan, pending before the Nantucket Planning
Board under File No. 2281, which effects certain minor boundary
line adjustments to the Locus, and shows the Locus as Lot 67A.
This decision shall relate to the present Lot 67, with the
structure to be upon that lot, and with the boundary lines to be
subject to modification as per the aforesaid pending plan.)
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. The Planning Board
recommendation was favorable, subject to the suggestion of
various conditions. Several members of the Nantucket business
community spoke in support, expressing the need for more housing
for employees. There was extensive expression of opposition
presented on behalf of neighbors and others at the public hearing
in person, by counsel and by correspondence. Opposition was
based upon the perceived intensity of use, potential noise, and
concern as to the Applicant's ability to ensure effective
management of the project.
4. The Locus is a vacant lot, situated in a Residential-2
zoning district in which duplex dwellings containing two dwelling
units are permitted as a matter of right. The Applicant proposes
to construct a duplex dwelling upon the Locus, to be used as an
employer dormitory, with a total of up to twenty-four occupants,
up to twelve in each of the two dwelling units. The Applicant
has accordingly applied in this matter for a Special Permit under
Nantucket Zoning By-law X139-7.D(4), for use of each of the two
dwelling units as an employer dormitory. (The Locus is situated
farther from the properties owned by objecting neighbors than any
of the other lots on which the Applicant proposed a similar use.)
Also, as the number of parking spaces required for an employer
dormitory for twenty-four occupants is thirteen, and the number
of parking spaces which the Applicant proposes to provide upon
the Locus is nine, the Applicant has requested parking relief by
Special Permit under Nantucket Zoning By-law ~139.18.B(4) to
waive up to 300 (four) of the required parking spaces. (Variances
from the parking requirements of X139-18 to waive two additional
parking spaces; and, to the extent necessary, from the
requirements of §139-19 as they relate to screening and driveway
width, were not pursued by the Applicant; the Applicant now
proposes to provide nine parking spaces, with compliance with all
requirements of X139-19).
5. An "Employer Dormitory" is defined in Bylaw X139-2 as
"[a] dwelling in which sleeping accommodations for two or more
persons are provided by one or more employers, with occupancy
limited solely to their employees". Employer dormitories are
allowed in all zoning districts by Special Permit from the
special permit granting authority; no standards for the issuance
of such Special Permits are set forth in the By-law except for
the general provision of X139-30.A(1) that "the special permit
granting authority may issue special permits for structures and
uses which are in harmony with the general purpose and intent of
this Zoning Bylaw [sic], subject to the provisions of such bylaw
[sic]". Relief from parking requirements, waiving up to 30% of
the spaces required under X139-18.A, may be granted by Special
Permit under X139-18.B(2) and (4) where the special permit
granting authority finds that the granting of the Special Permit
is in harmony with the general purpose and intent of the By-law,
and that compliance with the parking requirements under X139-18
"would (i) be physically impossible for the applicant to provide
or (ii) if physically practical, have a significant and adverse
effect on the scenic or historic integrity of the neighborhood,
or (iii) be contrary to sound traffic and safety considerations.
The purpose of the Zoning By-law, as set forth in §l, is to
promote the health, safety, convenience, morals and general
welfare of the Town's inhabitants, to lessen the danger from fire
and congestion, and to improve the Town.
6. The need for increased and appropriate housing for
summer employees is a matter of common knowledge on Nantucket,
and was spoken to by the applicant and by members of Nantucket's
business community at the public hearing. The applicant
presented nine separate applications for employer dormitories,
each to contain up to twenty-four occupants, upon the Locus and
eight other abutting or neighboring lots also owned by the
applicant; although these must be treated, as they were filed, as
separate applications each to stand or fall on its own merits,
they were presented together and the applicant proposed various
conditions for the granting of the requested Special Permits,
many of which related to proposed joint management of the
dormitories upon the several lots for which these applications
were filed. (Three of these nine applications [085-98, 086-98
and 087-98] were voluntarily withdrawn by the applicant without
prejudice before the conclusion of the public hearings, and the
applicant and the Board of Appeals proceeded to a decision on the
remaining six lots, including the Locus.) The requirement for a
Special Permit for an employer dormitory enables the Board of
Appeals, as the special permit granting authority specified in
the By-law, to impose conditions to ensure compliance with the
purpose and intent of the By-law, under §139-30.A(2) (Opponents
raised a question as to whether the proposed project would
constitute a Major Commercial Development ("MCD") as defined in
Zoning By-law X139-11, thus requiring issuance of a Special
Permit under that section by the Planning Board. However, the
proposed use as an employer dormitory is a residential use; an
employer dormitory is defined as a "dwelling" used in that
manner. The definition of MCD is expressly limited to commercial
structures or uses. Accordingly, the Board of Appeals determined
that the project did not constitute an MCD.)
7. The applicant represented to the Board of Appeals that
centralized management would be provided, in order to protect the
dormitories, their inhabitants, their abutters and neighbors, and
the Town generally from anticipated problems. The Locus is near
a Nantucket Regional Transportation Authority ("NRTA") seasonal
bus route, and the applicant offered to take actions to limit and
discourage the use and parking of automobiles by the inhabitants
of the dormitories. Various other conditions were proposed by
the applicant, and the motion for approval of the dormitory
proposed upon the Locus incorporated the following conditions for
the granting of the Special Permits for the employer dormitory
and requested parking relief in this application:

(b) The property owner shall install and permanently
maintain street signs in Pilot Whale Drive adjacent to the Locus,
stating the prohibition of on-street parking.
(c) The property owner shall be responsible to plant
and permanently maintain at least two shade trees of at least
four inches in caliper within the front yard setback area of the
Locus.
(d) All utilities serving the Locus shall be
underground, and water and sewer service shall be exclusively by
connection to public lines.
(e) All exterior lighting shall be directed generally
downward and so placed as to not be directed at any neighboring
parcels.
(f) The Locus shall be serviced by a commercial trash
removal service, with trash to be removed at regular, frequent
intervals year-round, as needed.
(g) No exterior storage of furniture, refuse,
mechanical components, debris, unregistered or inoperable
vehicles, or other materials constituting a nuisance, shall be
permitted upon the Locus.
(h) The dormitory building upon the Locus shall not be
used for the housing of any persons except for employees of an
owner of the Locus, or employees of a tenant of an owner of the
Locus. No portion of any building upon the Locus shall be rented
to any person for occupancy by such person; all tenants shall be
employers, and all occupants shall be employees of an owner or
tenant, who are. licensed by their respective employers to occupy
a space in the dormitory by virtue of their employment and for
only so long as their employment shall continue. No subtenancies
of the buildings upon the Locus or any portion thereof shall be
permitted.
(i) Each lease to an employer shall set forth that the
employer shall be responsible for compliance with all provisions
of these conditions by the employees of such employer and within
the area leased to such employer.
(~) The owner of the Locus shall at all times be a
member of a Lot Owners Association ("LOA"), of which the owners
of all lots on Pilot Whale Drive which are now owned by the
Trustee of Pilot Whale Realty Trust and which hold a Special
Permit for employer dormitory use shall be members, for so long a
time as the Special Permit for employer dormitory use shall
remain valid. The LOA shall be governed by a written instrument
establishing the rights and responsibilities of lot owners
consistent with the provisions hereof and any other conditions

set forth in the Special Permit issued for the subject lot, and
no building permit for the Locus shall be issued until the
Nantucket Building Commissioner has reviewed and approved the
provisions of such instrument. Such instrument shall provide for
the following matters:
(i) The LOA shall at all times contract with a
professional management company for the management, maintenance
and operations of all dormitories upon member lots. The
management company shall employ an individual resident manager,
who shall be resident at one of the dormitory buildings or
elsewhere on Pilot .Whale Drive, and shall be responsible to
inspect all units within each dormitory at least once per week
between May 1 and September 30 in each year. The LOA shall
further employ one or more unarmed security personnel, who shall
patrol Pilot Whale Drive and the grounds of each member lot
during the period between May 15 and September 15 in each year,
seven days per week, from 9:00 P.M. to 4:00 A.M. , at a minimum.
The resident manager shall keep an open log of neighbors'
complaints and of any action taken to abate each problem.
(ii) The names and telephone numbers of the
resident manager, and of each employer housing employees in each
dormitory by virtue of ownership or lease, shall be delivered to
each direct abutter of every lot now owned by the Applicant, and
shall be posted upon each separate mailbox upon each member lot.
This information shall be updated at the time of any change. It
shall further be filed with the Nantucket Police Department and
Nantucket Building Department. The resident manager shall be
provided with a paging device, with the telephone number provided
to the Nantucket Police Department.

(G) No destruction or defacing of property shall
be permitted.
(H) No conduct which the LOA or the resident
manager shall deem to be dangerous to any person, or to be a
nuisance or detriment to public safety and morals, shall be
permitted.
(I) No lewd, lascivious or indecent behavior or
activities shall be permitted upon the premises.
(K) No alcohol shall be consumed by any person
upon any exterior portion of any member lot, or anywhere except
within a building.
(L) No loud music or other noise violating the
Nantucket noise by-law or any other provision of law from time to
time in effect shall be permitted upon any member lot.
(M) The premises and grounds of each member lot
shall be kept neat and clean at all times.
(N) The total number of motor vehicles to be
permitted to be kept upon each member lot by the owners or
tenants of the lot or their employees shall not exceed the number
of on-site parking spaces provided upon the lot, less one. No
employee shall keep a motor vehicle upon any lot without the
consent of his or her employer. Each employer permitting an
employee to keep a motor vehicle upon any lot shall pay a fee to
the LOA in the amount that the LOA shall from time to time
determine, but not less than $200.00 per month. The management
company shall post signs in appropriate locations warning that
unauthorized vehicles will be towed, and shall contract with a
towing company for the removal of all such unauthorized vehicles
in a manner permitted by law.
(iv) The LOA shall be funded by contributions
which shall be assessed from time to time to the owner of each
member lot, pro rata, and failure to timely pay any such
assessment shall give rise to a lien which shall be enforced by
the LOA in any manner permitted by law.
(v) The LOA shall enforce all of the provisions
set forth in these conditions, and all the rules and regulations
established hereunder. In the event of any violation, the owner
of the lot where such violation occurs shall be liable to the LOA
for all costs of enforcement, including attorneys' fees.

(vi) An Advisory Board shall be constituted,
comprised of the members of the LOA, a representative of the
management company engaged by the LOA, each employer having
employees upon any member lot, a representative of the Nantucket
Police Department, a representative of the Nantucket Building
Department,-and each owner of any land abutting any member lot.
The Advisory Board shall conduct monthly meetings between May and
October in each year.
(vii) The LOP. shall, prior to the ,issuance of a
Certificate of Occupancy for any member lot, be funded by the
present applicant in the total amount of $20,000.00, in the form
of a cash deposit, bond or letter of credit, to secure its
performance of all of its obligations hereunder. Funds shall be
disbursed therefrom only if the LOA or the management company
have failed to act, and the Advisory Board so authorizes. Any
disbursements shall be reimbursed by assessments upon lot owners,
so that security in the amount of $20,000.00 is maintained at all
times. If, at the expiration of five years from the issuance of
the final Certificate of Occupancy for dormitory construction
upon a member lot, no funds have been disbursed from the initial
endowment, this endowment shall be terminated and returned to the
original 'applicant; subject, however, to the LOA's rights of
assessment and collection hereunder.

be held pursuant to legal notice as required for a Special Permit
application, in November of the first year after the issuance of
Certificates of Occupancy for all dormitories upon member lots,
and at another public hearing to be held in November of the
follo~.aing year, review all conditions set forth in this Special
Permi~,, and shall make such modifications and additions to these
conditions as the Board of Appeals shall deem appropriate for the
management and control of activities upon the member lots and the
best interests of the neighborhood and the Town generally.

8. Accordingly, by UNANIMOUS vote, the Board of Appeals
found that the granting of the requested Special Permit under
X139-7.D(4) for employer dormitory use upon the Locus as
proposed, with the safeguards provided by the imposition of the
conditions set forth in Paragraph 7 of this Decision, and
considering the relative distance of the Locus from the
properties of the objecting neighbors, would be in harmony with
the general purpose and intent of the Zoning By-law, and that the
requested relief by Special Permit under X139-18.B(4) from four
of the required thirteen parking spaces for the proposed twenty-
four person employer dormitory upon the Locus would be in harmony
with the general purpose and intent of the By-law, and that
compliance with the parking requirements under §139-18 would be
unnecessary and would accordingly have a significant and adverse
effect on the scenic or historic integrity of the neighborhood;
and GRANTED the requested Special Permits; subject, however, to
all of the above conditions. No Variance relief was granted, as
the Applicant indicated that none would be needed for the project

be held at 1:00 P.M., FRIDAY, SEPTEMBER 11, 1998, in the CONFERENCE
ROOM, TOWN ANNEX BUILDING, 37 WASHINGTON STREET, Nantucket,
Massachusetts, on the Application of the following:
PILOT WHALE NOMINEE TRUST
BOARD OF APPEALS FILE N0. 093-98
Applicant proposes to construct a duplex building that will be
used as employer dormitories, for which Applicant is seeking SPECIAL
PERMIT relief under Nantucket Zoning By-Law §139-7D(4). Thirteen (13)
parking spaces are required for this use. Applicant will provide up to
seven (7) off-street parking spaces on site. Therefore, relief is being
sought under Nantucket Zoning By-Law §139-18 and specifically under
§139-18B(4) to waive up to 30% (4) of the required parking spaces and a
VARIANCE under §139-18 to waive the remaining two (2) parking spaces.
Should the need arise to waive additional parking spaces by additional
Variance relief above the two (2) as proposed, Applicant is hereby
seeking such relief. In addition, and to the extent necessary, Applicant
is seeking VARIANCE relief under Nantucket Zoning By-Law §139-19 as it
relates to screening and driveway width. See also BOA File Nos. 085-98
