At a Public Hearing of the Nantucket Zoning Board of Appeals held at 1:00 p.m.,
Friday, September 11, 1998, in the Selectmen's Meeting Room, Town Annex Building,
37 Washington Street, Nantucket, Massachusetts, on the Application of THOMAS B.
MCGLINN FQR HIMSELF AS OWNER AND FOR MICHAEL MOLINAR AS
CONTRACT PURCHASER, of P.O. Box 1194, Nantucket, MA 02554 and 16 Winn
Road, Nantucket, MA 02554 respectively, Board of Appeals File No. 083-98, the Board
made the following Decision;
1. Applicant (Molinar) is seeking SPECIAL PERMIT relief under Zoning By-
Law Section 139-16 (off-street parking requirements}, under Section 139-20 (off-street
loading requirements). and under Section 139-33A{1) (alterationlexpansion of a pre-
existing, non-conforming structure/use). Applicant proposes to convert an existing two-
story, single-family dwelling into one retail shop that would have retail space on the first
and second floor. The proposed retail space would have up to a total of about 2,400
square feet with the basement having about 1,100 square feet of storage space. The
retail use could require up to six (6) employees on site at peak shift. The new use
would require up to sixteen (16} parking spaces. Applicant can provide one complying
parking space on site and two (2) non-conforming spaces, one (1) in the existing
garage and one (1) stacked in front of the conforming space in the existing driveway.
Therefore, Applicant is seeking Special Permit relief waiving up to fifteen (15} parking
spaces for the proposed retail use. No exterior changes, except the addition of
handicap access and a possible change of a window to a door, are planned. The
Locus is non-conforming as to side yard setback, with the garage sited 2.42+ feet at its
closest point from the easterly side yard lot line in a district that requires a minimum
setback of five (5) feet.
The premises is located at 1 Chestnut Street, Assessor's Map 42.3.1,
Parcel 7. The property is zoned Residential/Commercial.
2. The Decision is based upon the Application and the material submitted
with it and the testimony and evidence presented at the Hearing. The Planning Board
made a favorable recommendation. There was a fetter from the closest abutter and the
abutter across the street in support of the Application. An Abutter spoke in favor of the
Application. There was no opposition on record to the Application.
3. Applicant, through, counsel, represented that he is proposing to move his
existing business "Flowers at the Boarding House" to the subject property, currently a
single-family dwelling. He is not proposing any exterior changes other than changing a
window to a door and making it handicap accessible. The pre-existing garage is 2.42+
from the easterly side yard lot tine and will remain in its existing location. The
proposed retail space with a square footage of two thousand six hundred seventy-three
(2,673 ± )1 the storage space with a square footage of one thousand three hundred
{1,300 +) in the basemen and up to a maximum of six (6) employees on site at peak
shift would require sixteen {16) parking spaces. Applicant can provide one (1)
complying space on-site and two (2) non-complying spaces in the existing driveway.

Thus, a waiver of fifteen (15} spaces is being sought. Also, waiver of the {oading zone
requirements is also being sought as one cannot be provided on site.
4. Therefore, the Board finds that Special Permit relief under Section 139-
33A(1) to change from residential use to one {1) retail shop will not be substantially
more detrimental to the neighborhood- The Board also finds that the waiver of fifteen
(15} parking spaces, with one (1) conforming space and two (2) non-conforming spaces
being provided on-site, and the waiver of the loading zone requirement, is in harmony
with the purpose and intent of the Zoning By-Law and not contrary to sound traffic and
safety considerations. The Board notes that a waiver of up to 100% of the required
parking spaces is available by Special Permit within the Core District when deemed
physically impossible to provide on site. The Board further notes that there are
designated, on-street loading zones in the immediate area.

5. Accordingly, by a unanimous vote, .the Board GRANTS the requested
relief to convert the existing residential structure to retail use under Nantucket Zoning
By-Law Section 139-33A(1), and a SPECIAL PERMIT under Nantucket Zoning By-Law
Section 139-18 to waive fifteen (15} parking spaces and under Section 139-20C~
waiving the loading zone requirements, under the following conditions: ~~
{a} the retail business will close no later than 9 p. m.~ ~ ~~~~° I`~~
(b) there shall be no more than two thousand six hundred seventy-
three (2,673 ±) square feet of retail space and no more than one
thousand three hundred (1,300 +) square feet of storage space
on site
{c} there will be only one (1 }retail business on site; and
(d) no more than a maximum of six (6) employees on site at peak shift.

Applicant is seeking SPECIAL PERMIT relief under Zoning By-Law Section 139-
18 (off-street parking requirements), under Zoning By-Law Section 139-20 (off-street
loading requirements). and under Zoning By-Law Section 139-33A(1). Applicant
proposes to convert an existing two-story, single-family dwelling to retail use. The
proposed retail space will have a total of 1,179 square feet on the first and second
floors. The basement has 1,059 square feet and will be used for storage space. The
retail use could require up to six (6) employees on site at peak shift. The retail use with
the ancillary storage space with a total of six employees would require twelve (12)
parking spaces. Applicant can provide three on-site spaces; one in the garage and two
stacked spaces in the driveway (one of which complies to the by-law and one does
not). If the Board accept the three on-site spaces, relief will be necessary for only nine
(9) spaces.
Applicant does not propose any exterior changes except the addition of
handicap access and a possible change of a window to a door.
