A Public Hearing of the Nantucket Zoning Board of Appeals will
be held at 1:00 P.M., FRIDAY, SEPTEMBER 11, 1998, in the CONFERENCE
ROOM, TOWN ANNEX BUILDING, 37 WASHINGTON STREET, Nantucket,
Massachusetts, on the Application of the following:
NANTUCKET YACHT CLUB
BOARD OF APPEALS FILE N0. 082-98
Applicant is seeking a VARIANCE from the Intensity Regulations of
Nantucket Zoning By-Law §139-16A (side yard setbacks). Applicants
predecessor in title obtained a Building Permit in 1982 to construct an
addition onto the northwesterly portion of an existing single-family
dwelling. This addition violates the rear yard setback requirements
being sited 1.57+ feet at its closest point from the rear yard lot line
in a district that requires a minimum side and rear yard setback of ten
(10) feet. Applicant is seeking a Variance to validate the structure as
it is currently sited. The Locus is currently nonconforming as to lot
area having less than the required minimum lot size of 10,000 square
feet; as to frontage, having 51.00+ feet of frontage along Nektown
Road; as to ground cover ratio having a ratio of 22.9+°~ in a district
that requires a minimum ground cover ratio of 20%; and as to side and
rear yard setbacks, with the structure .being sited closer than the
required ten (10) feet for its entire length along the rear yard lot
line and at 5.07+ feet at its closest point along the southeasterly side
yard lot line.
The Premises is located at 2R HOOPER FARM ROAD, (AKA 12 Sparks
Avenue), Assessor's Map 55, Parcel 205, shown as Lot 1, Plan Book 15,
Page 56 and .as Lot 3 in Registry of Deeds Book 17, Page 116 on a Plan in
File No. 887, dated July 14, 1971, endorsed by the Nantucket Planning
Board. The property is zoned Residential-10.

Applicant's predecessor Fin title, Edward J. Strojny, obtained a building permit
in 1982 to construct a bedroom addition to property at 12 Sparks Avenue (Building
Permit No. 2523-82). This addition did not increase ground cover as they merely
enclosed a second floor roof deck. However, the existing building violates the
set-back requirements at the time, so Strojny should have gone to the Board of
Appeals before he obtained the building permit. Applicatn needs relief from the
Board of Appeals to approve this addition which was constructed in 1982.
