X2554 SE_P 18 1998 NANTUCKET ZONING BOARD OF APPEALS DECISION Map 42.2.2, Parcels 27 & 7 Certificate of Title No. 11997 10 South Beach Street & Land Court Plan Nos. 12 Oak Street 8755-B (Lot 3) & Nantucket, Massachusetts 8755-G (Lot 19) At a Public Hearing of the Nantucket Zoning Board of Appeals held at 10:00 a.m. on Wednesday, September 16, 1998 in the Town Building at 37 Washington Street, Nantucket, Massachusetts, on the application of HARBORVIEW SHOPKEEPERS TRUST, MARIO TEIXEIRA, TRUSTEE, u/d/t dated August 16, 1985, registered as Document No. 33335 at the Nantucket Registry District for the Land Court, of 35 Main Street, Nantucket, Massachusetts 02554 (Board of Appeals File No. 081-98) in connection with the above referenced property, the Board made the following Decision: 1. Applicant is seeking a MODIFICATION of a SPECIAL PERMIT granted in a Decision in BOA File No. 014-97, and a VARIANCE from the open area requirements of Nantucket Zoning By-Law Section 139-16E. Applicant proposes to pave the gravel parking area and the area on the east side of the existing structure. Said Section 139-16E requires that twenty (20$) per cent of the lot area be open area free from impervious surface with a maximum credit of ten (10$) per cent of lot area for brick sidewalks. Applicant's lot area is 8,676 square feet requiring 1,736 square feet of "open area". Currently, Applicant's site has 1,328+ square feet of brick sidewalk, however, only 867.6 square feet may be counted as open area. Applicant's graveled parking area contains 2,807+ square feet and the graveled area on the easterly side of the building contains 460+ square feet. Applicant is seeking a VARIANCE to reduce the twenty (20~) per cent open area to ten (10$) per cent open area and a MODIFICATION of Paragraph 5(d) of the Decision in BOA File No. 014-97 which requires that "the parking area be constructed from gravel or a similar pervious surface", in order to pave the parking area and east side of the building. See also BOA File Nos. 015-79, 027-90A/B, and 064-90. The Premises is located at 10 SOUTH BEACH STREET and 12 OAK STREET, Assessor's Map 42.4.2, Parcels 70 and 27, Land Court Plan 8755-B, Lot 3 and Land Court Plan 8755-G, Lot 19. The property is zoned Residential-Commercial. 2. This decision is based on the application and materials received with it and testimony of applicant's civil engineer and evidence submitted at the public hearing. The Planning Board recommended granting of relief to reduce the open space require- ment to ten (10~) per cent. One (1) letter was received from an abutter who was concerned that the paving of the gravel areas would increase run-off from premises. 3. In accordance with the Special Permit previously granted by this Board, applicant has constructed a commercial-residential building upon the premises containing four (4) retail/office spaces on the first floor and two (2) apartments on the second floor with a gravel parking area containing four (4) parking spaces. The existing gravel parking area and the graveled area on the easterly side of premises contain 3,267 sq. ft., more or less. 4. In accordance with the provisions of Chapter 21-E, M.G.L., applicant conducted an environmental site assessment and limited subsurface investigation of the premises which disclosed the presence of Extractable Petroleum Hydrocarbons, Polycyclic Aromatic Hydrocarbons and Volatile Petroleum Hydrocarbons in on- site soil and ground water. Because of the presence of contaminants, applicant must impose an Activity and Use Limitation (AUL) to assure a condition of no significant risk to the public in the future by installing a permanent engineered barrier to prevent contact exposure to contaminated soils. The AUL consists of the installation of a porous geotextile membrane on the soil and placing paving bricks with sand or gravel used as the base and filler and will match the existing sidewalks. The water runoff characteristics of this system will be essentially the same as existing conditions thereby not increasing the effect on abutters to the premises. 5. The Board finds that the purpose of the Zoning By-law is to promote the health and safety of the inhabitants of Nantucket. The soil conditions especially affecting applicant's premises but not affecting generally the zoning district have created a substantial hardship on applicant as applicant must comply with the provisions of Chapter 21-E, M.G.L. in order to protect the public from the contaminants in the soil which prevents applicant from maintaining twenty (20$) per cent open area. Therefore, the Board finds that the requested relief for variance and grant of modification can be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the By-law. 6. Accordingly, by UNANIMOUS vote, the Board hereby GRANTS the requested VARIANCE of Section 139-16(E) to reduce the required open area from twenty (20~) per cent to ten (10~) per cent of premises and by a UNANIMOUS vote GRANTS the applicant's request to modify Special Permit No. 014-97 by modifying the condition set forth in Paragraph 5(d) thereof and permitting the parking area and side yard to be covered with brick.
