E. BIERLY, JR. AND CHRISTOPHER B. DRAKE, CONTRACT PURCHASERS BOARD OF APPEALS FILE N0. 080-98 The Applicants, as contract purchasers, wish to renovate an existing theatre workshop building for use as a single-family dwelling, and to remove an existing portable structure used for storage. The theatre workshop structure, said to have pre-existed the 1972 enactment of the Zoning By-Law, is nonconforming as to side yard setback, with the structure being sited about 2.2 feet from the westerly side yard lot line at the closest point, with required setback being five (5) feet; and present ground cover ratio is .about 1,945 square feet, for a ratio of about 44.9%, with maximum allowable for an undersized lot being 30%• The Lot is a nonconforming lot of record, having an area of about 4,330 square feet;-with minimum required lot area in this district of 5,000 square feet, and having frontage of abut 46.02 feet, with minimum frontage required in this district of 50 feet. The Applicants propose to construct an addition with ground cover of about 88 feet, which would result in ground cover, after removal of the storage structure and an existing trash receptacle of about 1,850 square feet, for a ratio of about 42.7%. The westerly side yard setback nonconformity will be unchanged; and the easterly side yard setback nonconformity will be eliminated. Accordingly, the Applicants request a SPECIAL PERMIT under Nantucket Zoning By-Law §139-33A(4) and (5), for the alteration of a pre-existing nonconforming structure, including upward extensions within existing setback areas not increasing any intrusions into the setback area, based upon a finding that the proposed changes will not be substantially more detrimental to the neighborhood than the existing nonconformities.
