DECISION:
At a public hearing of the Nantucket Zoning Board of
Appeals, on Friday, September 11, 1998 at 1:00 P.M., in the
Selectmen's Meeting Room, at the Conference Room, Town Annex
Building, 37 Washington Street, Nantucket, Massachusetts, on the
application of JEROME L. RAPPAPORT and PHYLLIS E. RAPPAPORT, c/o
Reade, Gullicksen, Hanley & Gifford, LLP, Six Young's Way, Post
Office Box 2669, Nantucket, Massachusetts 02584, Board of Appeals
File No. 079-98, the Board made the following DECISION:
1. The Applicants are seeking xelief from the ground cover
maximum limitation of 1,500 square feet or 12.50 of lot area,
whichever is greater, for a pre-existing, non-conforming
undersized lot of record, containing about 7,623 square feet in a
district in which minimum lot area is 20,000 square feet and a
SPECIAL PERMIT under Nantucket Zoning By-law X139-33.A(5), for
the extension of an existing structure which encroaches upon the
required front yard setback of 30 feet, as measured from Bayberry
Lane, with the nonconforming setback distances not being made
more nonconforming. The Applicants propose to construct an
addition of about 108 square feet in ground cover, which will be
within the required front yard setback from Bayberry Lane, but
will not be closer than the present setback of about 3.7 feet; at
its closest point, the addition will be about 6.1 feet from
Bayberry Lane. The present maximum ground cover permitted for
the subject property is 1,500 square feet, which exceeds 12.50 of
lot area. Present ground cover is about 1,746 square feet;
before alterations performed in 1994 pursuant to Special Permits
granted by the Board of Appeals, ground cover was about 2,223
square feet. The Applicants request MODIFICATION of the SPECIAL
PERMITS granted in Board of Appeals File Nos. 172-93 and 086-93,
to permit the proposed addition, as a further alteration of a
pre-existing nonconforming structure upon the subject property,
as well as SPECIAL PERMIT relief under Zoning By-law X139-33.A(5)
as>set forth above. In the alternative, the Applicants request
relief by VARIANCE from the ground cover requirement under Zoning
By-law X139-16.A and X139-33.E(2)(b) See also Board of Appeals
File Nos. 029-73, 066-93, and 019-96. The subject property (the
"Locus") is situated at 72 BAXTER ROAD, SIASCONSET, Assessor's
Map 49, Parcel 44, shown on plan recorded with Nantucket Deeds in
Plan File 43-B, and is zoned as Residential-2.
2. This Decision is based upon the. application and
materials submitted with it, and the testimony and evidence
presented at the public hearing. There was no Planning Board
recommendation, the subject application being determined by the
Planning Board to not be of planning concern. There were six
letters received from abutters and other neighbors in support of
the application; no opposition was received,- in person or by
correspondence.
3. As set forth in the prior Board of Appeals cases cited
above, the Locus has been the subject of much consideration by
the Board. In Case No. 129-73, the Board granted variance relief
for alteration of the garage upon the Locus, inserting the
condition that "no additional structural improvements of any kind
be allowed on the land of the petitioner". In Case No. 022-93
the Board granted a Special Permit to allow the alteration of the
main dwelling upon the Locus within its existing footprint as a
single-story structure and removed the prohibition on structural
improvements as set forth in the Decision in Case No. 029-73. In
Case No. 066-93, the Board refused to grant a Special Permit to
replace the garage with a cottage with attached garage, reducing
ground cover. from about 2,223 square feet to about 2,160 square
feet and conforming to side and rear yard setbacks. In Case No.
086-93, the Board granted a Special Permit allowing an addition
to the dwelling, with demolition and replacement of the garage
with a smaller single-story garage structure containing no living
space, and with ground cover to be reduced from about 2,223
square feet to about 1,738 square feet. Finally, in Case No.
019-96, the Board granted a modification of the. Special Permit in
Case No. 186-93, to eliminate the garage use of the ancillary
structure and to use it as a studio with bathroom, not to contain
a kitchen nor to be used for human habitation.
4. The Applicants now request the Board's permission to
construct an addition of about 108 square feet, explaining that
the existing bathroom serving the master bedroom is extremely
small, with a very small tub which is difficult of access, and
that the existing floor plan makes it necessary to construct an
addition in order to provide a reasonably-sized tub and separate
shower. The location of the addition, toward the intersection of
Baxter Road and Bayberry Lane, is well-screened by a mature hedge
which minimizes impact upon the surrounding area. Both abutters,
and several other neighbors, wrote letters in support of the
project. Because of the angle of the line of the house nearest
to Bayberry Lane, the addition will be farther from the shed line
than the existing structure; no other setback issues are
presented. The increase in ground cover is done in the context
of the modification of a prior special permit which allowed
reduction in ground cover but did not bring the Locus into
conformity with ground cover requirements; accordingly, no new
relief is needed in order to permit the proposed increase in
ground cover, just a modification of the existing special permit.
5. Accordingly, by UNANIMOUS vote, the Board granted (a)
Modification of the Special Permit granted in Cases Nos. 022-93
and 086-93, to permit the proposed addition as alteration of a
pre-existing nonconforming structure, finding that the proposed

alteration will not be substantially more detrimental to the
neighborhood than the existing nonconformity, and (b) a Special
Permit under Nantucket Zoning By-law X139-33.A(5) to allow the
extension of the existing structure within the front yard setback
without making the nonconforming setback more nonconforming and
again finding that the extension will not be substantially more
detrimental to the neighborhood, upon the condition that the
alterations shall be performed in substantial conformity to the
plans submitted to the Nantucket Historic District Commission and
approved under Certificate of Approp~ateness No. 32,'13.^
