At a Public Hearing of the Nantucket Zoning Board of Appeals
held at 1:00 P.M., Friday, September 11, 1998, and continued to
October 16, 1998 and then to November 4, 1998, on Board of Appeals File
No. 078-98 and companion case No. 095-98, which was heard October 16,
1998 and continued to November 4, 1998, in the Conference Room, Town
Annex Building, 37 Washington Street, Nantucket, Massachusetts, on the
Application of RICHARD C. AND MARINA AUSTIN, FOR THEMSELVES AS OWNERS
AND FOR SALLYANNE AUSTIN, of P.O. Box 193, Nantucket, MA 02554, the
Board made the following Decision:
1. Applicant (Sallyanne Austin) is seeking a SPECIAL PERMIT under
Nantucket Zoning By-Law §139-8B(2) (Neighborhood service establishment)
and the subject of BOA File No. 078-98, and a SPECIAL PERMIT under
Nantucket Zoning By-Law §139-33A (alteration/expansion of a
pre-existing nonconforming structure/use) and the subject of BOA File
No. 095-98. Applicant proposes to convert a 613+ square-foot garage
structure located on the southerly portion of the Lot to use as a
hair/nail salon with up to three (3) employees on site at peak shift.
Applicant will provide the five (5) required off-street parking spaces
on site with the proposed parking area being located to the north of
the existing single-family dwelling. There will continue to be one (1)
access to the property. In addition and to the extent necessary,
Applicant is also seeking a SPECIAL PERMIT under Nantucket Zoning
By-Law §139-20C waiving the loading zone requirements. The structure is
non-conforming as to side yard setback with the garage being sited 3.5+
feet at its closest point from the southerly side yard lot line in a
district that requires a minimum setback of ten (10) feet.
The Premises is located at 19 SURFSIDE ROAD, Assessor's Map 55,
Parcel 265, Plan File 13E, Lots 7 and 8, Plan Book 9, Page 8. The
property is zoned Residential-10.
2. The Decision is based upon the Application and the materials
submitted with it and the testimony and evidence presented at the
hearing. The Planning Board made a negative recommendation until the
Applicant be required to submit an adequate site plan which the
Applicant complied with at the November 4, 1998 meeting. A letter was
submitted from the manager of the Wannacomet Water Company, as required
by Nantucket Zoning By-Law §139-12B(3)(a), attesting to his finding
that the project as proposed would not have an adverse impact on the
groundwater quality within the Wellhead Protection District. There were
no letters in opposition or in support of the Application on file. The
direct abutter to the rear was present at the earlier hearings and
expressed concern about the use of a private way for access, screening
of the parking area and noise. Her attorney was present at the October
16, 1998 hearing.
3. Applicant proposed to convert the use of the existing garage to
a hair and nail salon and while maintaining the single-family dwelling
upon the Locus as her home. The existing garage door would be removed,
and a fence placed across the driveway entrance at that point, as well
as other changes to the structure to bring it into building code
compliance. There would be no changes to the footprint of that portion
of the garage that is situated within the required ten-foot side yard
setback area in which the structure intruded by 6.5 feet at its closest
point to the southerly side yard lot line. There would be a maximum of
three (3) employees on site at peak shift. A turn around area would be
provided to enable vehicles to avoid backing out onto the bike path
that runs along the front of the structure and no vehicular access
would be allowed onto the private way to the north known as Cobble
Court.
4. Therefore, the Board finds that, based upon the foregoing, a
grant of relief by Special Permit to allow the conversion of the garage
into use as a hair and nail salon would be in harmony with the general
purpose and intent of the Zoning By-Law and would not be substantially
more detrimental to the neighborhood than the existing nonconforming
nature of the garage. The Board notes that there would be no further
intrusion into the side yard setback area and the area was comprised of
mixed commercial and residential uses. The Board determined that relief
by Special Permit to waive the loading zone requirement was not needed
as it was not applicable.
5. Accordingly, the Board, by a unanimous vote, GRANTS the
requested relief by SPECIAL PERMIT under Nantucket Zoning By-Law
§139-8B(2) and §139-33A to convert the garage structure as proposed,
upon the following conditions:
a. The existing vegetation along the property line that
abuts Cobble Court shall be maintained and along the rear lot line the
existing vegetation shall be augmented with arbor vitae and be
maintained to provide dense screening of the parking area from the
abutter to the rear;
b. There shall be no vehicular entrance into the driveway in
front of the garage and the entrance shall be restricted by a fence
upon conversion of the garage to the hair and nail salon;
c. The project shall be completed in substantial conformance
with the site plan shown as "New Exhibit A - Revised 2/5/99" done for
Richard C and Maybelle M. Austin, dated 11/3/98, by Charles W. Hart &
Associates, Inc. and attached hereto, making particular note that there
shall be only one curb cut on the Locus from Surf side Road;
d. There shall be a maximum of three (3) employees on site at
peak shift;
e. This relief shall be particular to this Applicant and shall
terminate upon the conveyance out of the family to a
successor-in-title.
