Friday, August 14,1998, in the Conference Room, Town Building Annex, 37
Washington Street, Nantucket, Massachusetts, on the Application of HARVEY C.
JONES, JR., AND BARBARA E. jONES, TRUSTEES OF RAY'S COURT REALTY TRUST
u/d/t dated November 18,1997, of 212 Waverley Street, Palo Alto, CA 94301, for
themselves as Owners and Applicants in connection with property situated at 3 Ray's
Court (Board of Appeals File No. 073-98). The Board made the following decision:
1. Applicants are seeking a SPECIAL PERMIT under Nantucket Zoning By-
LawSection 139-33A {alteration/extension of apre-existing/non-conforming
use/structure}. Applicants propose to renovate a said to be pre-existing 955± single-
family dwelling which would involve relocating the main mass of the structure from
the east side of the Lot to the west side with the rear portions of the building being
reconfigured so as to slightly lessen the overall ground cover ratio of 36.5+% and to
conform to all setback requirements- Parking for two {2) vehicles on site will be
provided. Any renovations within the required setback areas would not come any
closer to the lot lines. The Locus is non-conforming as to lot size, with the Lot having
an area of 2600± square feet in a district that requires a minimum Iot size of 5,000 square
feet; as to ground cover ratio with the Lot containing 955± square feet of ground cover
with a 37+°~ ground cover ratio, in a district that allows a maximum ground cover ratio
of 30% for undersized lots; and as to setbacks, with the structure being sited less than
the required five (5} feet from the westerly and easterly side yard lot lines at its closest
points.
The premises is located at 3 RAY'S COURT, Assessor`s Map 42.31, Parcel 52.
The property is zoned Residential -Old -Historic.
2. The Board's findings are based upon the Application papers and
testimony received at the meeting on Friday, August 14,1998, from abutters and the
Applicants' representatives. One letter in support of the application was received from

an abutter. The Planning Board made no recommendation as the matter was not of a
planning concern.
3. The proposed renovation will involve moving the main mass of the existing
single-family dwelling to a new foundation on the west side of the lot, demolishing the
existing rear wing and constructing a new wing to the east of the relocated main
portion of the existing structure, effectively reversing the one- and two-story elements
of the structure. Elevation drawings of the proposed project, as approved by the
historic Districts Commission (Certificate of Appropriateness No. 32590}, were
submitted at the public hearing. Abutters to the property expressed concern about the
time of the year that exterior construction could occur given the densely settleei nature
of the neighborhood, and sought to have the mature vegetative screening along the
westerly property Iine preserved to the extent practicable. The proposed partially
renovated-and partially newly constructed dwelling will result in a slight reduetion of
the existing ground cover ratio from 37% to approximately 36.5% and will conform to
a1i setback requirements thereby correcting the existing setback intrusions. An
additional parking space will be provided on the lot when the parking area moves from
the west side of the structure to the east side.
4. Therefore, based on the information presented at the hearing, the Board finds
that (a) the existing single-family dwelling on the property, non-conforming as to
ground cover and setback predates 1972, (b} the proposed project does not increase the
non-conforming nature of the structure, and (c) the proposed project is not substantially
more detrimental to the neighborhood than the existing non-conforming structure.
Therefore, the proposed changes will benefit the neighborhood by rehabilitating a,n
existing dwelling in a historically appropriate manner and regularizing some of the
non-conforming aspects of the structure
~, Accordingly, based on the foregoing findings, the Board hereby GRANTS,
by a unanimous vote in favor, the requested Special Permit under Nantucket Zoning
By-law Section 139-33A to allow the renovation and reconstruction of the structure as
proposed, upon the following conditions:
a. The dwelling shall be renovated and constructed substantially as shown on
the plans approved by the Historic District Commission (Certificate of
Appropriateness No. 32590};
b. No exterior construction shall occur between May 15~ and October 20~ in
any given year;
c. In the event this property is conveyed separately from One Ray's Court (see
ZBA File No. 72-88), one (1} of the two {2) parking spaces being provided on
this property as a result of this project shall be dedicated for use by the One
Ray's Court property and an easement to that effect shall be granted at the

tune o~ such conveyance and recorded at the Nantucket County 1Zegistry of
Deeds;
d. The existing mature vegetative screening along the western property line
shall be zetained to the extent possible, or if impacted during construction,
replaced as soon as practical after construction is complete; and
e. Any increase in the ridge height of the western portion of the relocated
stzucture over and above the height appzoved by the historic District
Commission shall zequire the further approval of tlus Board. ~

Addendum -Three Ray's Court
The Applicant seeks a Special Permit under Section 139-33A for the '
renovation of the existing dwelling. The Lot consists of approximately 2,600
square feet and the dwelling, which predates 1972, is validly non-conforming as
to ground cover ratio (37%) and setbacks on both sides. A progress print from
Nantucket Surveyors showing existing conditions is attached. Major renovations
are proposed involving relocating the main mass of the structure from the east
side of the lot to the west side with the rear portions of the building being
reconfigured so as to slightly lessen the overall ground cover ration (36.5
proposed) and to conform to all setback requirements. Existing elevation
drawings are attached and proposed elevations will be available for the public
hearing. The proposed site plan shows two parking spaces being provided as a
result of the renovation.
