At a Public Hearing of the Nantucket Zoning Board of Appeals held
at 1:00 P.M., Friday, August 14, 1998, in the Conference Room, Town Annex
Building, 37 Washington Street, Nantucket, Massachusetts, on the
Application of ROBERT J. RAMOS AND SHARMAN S. RAMOS, of 11 Ramos .Court,
Nantucket, MA 02554, Board of Appeals File No. 071-98, the Board made the
following Decision:
1. Applicants are seeking a SPECIAL PERMIT under Nantucket Zoning
By-Law §139-9B(2)(a), (b) and (c) (light manufacturing; storage and
warehousing; and fabrication and assembly of component parts for off-site
construction or use, respectively). Applicants propose to construct a
4-bay commercial building, with two (2) second-floor apartments, on a
vacant lot. Applicants will use the structure in conjunction ~Tith their
well-drilling, plumbing and irrigation business. Applicants also seek, to
the extent necessary, relief by SPECIAL PERMIT under Nantucket Zoning
By-Law §139-18 (Off-street parking requirements) and/or §139-20C (loading
zone requirements).
The Premises is located at 6 THIRTY ACRES LANE, Assessor's Map
67, Parcel 115.4, Plan File No. 48-G, Lot 6. The property is zoned
Residential-Commercial-2.
2. The Decision is based upon the Application and materials submitted
with it and the testimony and evidence presented at the Hearing. The
Planning Board made a favorable recommendation as to use and waiver of the
loading zone and parking spaces suggesting that revisions be made to the
parking plan and the common driveway be maintained and not widened beyond
twelve (12) feet from the property line. There was a letter from the
Manager of the Wannacomet Water Company stating that the proposed project
would not have an adverse impact on the groundwater quality in the
Wellhead Protection District. There were no further letters on file in
support or opposition.
3. Applicants propose to construct a 2,700+ square-foot 4-bay garage
structure with two (2) second-floor apartments, on a vacant 8,301+
square-foot lot that would be used in conjunction with Applicants'
well-drilling, plumbing and irrigation business. The entire project will
contain less than 4,000 square feet of commercial floor area, the
threshold for a Major Commercial Development designation. Applicants
represent that there is insufficient room on the Lot to allow for both
the requisite parking spaces as well as the loading zone. Applicants will
store the commercial vehicles inside the building and due to the length
of said vehicles, the structure needed to meet certain dimensional
requirements. The Lots in this subdivision are trapezoidal, with the
narrowest part of the Lot located at the westerly front portion of the
Lot. The parking area is accessed from a shared driveway Frith an
adjacent lot to the north, as required by the Planning Board, thus not
allowing the flexibility to redesign the par}sing layout to accommodate a
loading zone and five (5) parking spaces. The structure is sited to the
rear of the Lot in the widest portion which allows it to meet all setback
requirements. Applicants further cited previous similar relief that was
granted, in the Decision in BOA File No. 0}.1-97, to another lot in this
subdivision that presented similar constraints on space allocation for
the provision of parking spaces and loading zone. Applicants further
represented that there was sufficient room s~rithin the cul-de-sac layout
of the private road ~,rithin this development to accommodate any delivery
trucks without interfering with the flow of traffic. The Locus is
bordered by other commercial lots with commercial uses on them. The Lot
is situated within the in'ellhead Protection District so the par}sing area
~,rould be gravel or some other previous surface and not paved. Applicants
have received a Certificate of Appropriateness No. ~~~(oSS`~ issued by
the Nantucket-Historic District Commission. ---
4. Therefore, the- Board finds that the grant of relief by Special
Permit to allow the use of the new building as proposed ~,rould be in
harmony with the general purpose anti intent of the Zoning By-Law. The
area is already substantially commercially developed and the Board finds
that this use would be ap;~ropriate for the zoning district in which the
Locus is situated. As to Special Permit relief waiving par}sing and/or
loading zone requirements, after the Board reviewed three (3) separate
proposed parking plans, the Board accepted "Option 1" as shotirn on a plot
plan dated June 25, 1998, done by Nantucket Surveyors, Inc., marked as
Exhibit A and attached hereto, preferring that Applicants provide six (6)
off-street parking spaces on site, and finding that a waiver of the
loading zone requirement would be in harmony i~rith the general purpose and
intent of the Zoning By-Law and not contrary to sound traffic and safety
considerations. There is sufficient area ~vithin the private road to
accommodate any deliveries and in fact there is space within the lot area
to pull off the road if necessary to unload. The Board further finds that
the project does not require Minor Site Plan Review as per Nantucket
Zoning By-Law §139-23.
5. Accordingly, by a unanimous vote, the Board GRANTS the requested
relief by SPECIAL PERMIT under Nantucket Zoning By-Law §139-9B(2)(a), (b)
and (c) and §139-20 to allow use of the structure as proposed and waiving
the loading zone requirement, respectively, upon the following conditions:
a. The hours of commercial operation shall be from 7:00 A.M. to
7:00 P.M., with no operation on Sundays;
b. Applicant shall provide and maintain adequate screening by
fencing or vegetation, alone the easterly rear .lot line, and at a minimum
up to the front }wilding line along the northerly side yard lot line and
along the southerly lot line;
c. The interior wor}c area shall be adequately vented and
soundproofed to minimize noise when power equipment is-being used;
d. The parking area shall be constructed in substantial
conformance with "Option 1", as shown on a plan dated June 25, 1998,
prepared by Nantucket Surveyors, Inc., marked as Exhibit A and attached
hereto; and
e. The structure shall be

I have reviewed the site plan for the above referenced project and offer the
following.
1. The property is located within the Wellhead Protection District.
2. The proposed use for the site will not have a negative impact on the existing
drainage for this site or the Thirty Acres subdivision.
3. The drainage from the proposed parking lot will allow for drainage of
stormwater to the vegetated areas for biological treatment and recharge.
4. Stormwater runoff from the common easement driveway will be dealt with by
the previously approved stormwater system for the Thirty Acres subdivision.
Therefore, I find that this project will not have an adverse impact on the
groundwater quality and is hereby approved by the Wannacomet Water Company under
X139-12B(3)(a) of the Nantucket Zoning By-Law.
