At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, July 10, 1998, at 1:00 P..M., in the Conference Room, in the Town Annex Building, 37 Washington Street, Nantucket, Maesaehuaetts, the Board made the following decision on the application of RAY W. GRUBBS and ELIZABETIi G. GRUBBS, c/o Reads & Alger Professional Corporation, Poet Office Box 2669, Nantucket, Massachusetts 02584, File No. 067-98: 2. The applicants are seeking a VARIANCE from the provisions of Nantucket Zoning By-Iaw §139-16.A (Intensity Regulations - minimum lot area and frontage) to validate the siting of their existing single-family dwelling and to validate the subject property, as. presently configured, as separately marketable from all adjacent land. The applicants further propose to construct an addition to the• dwelling which would comply with applicable dimensional zoning requirements, and request that the decision granting a variance state that alterations which do not violate any dimensional requirements under the Zoning By-law will be permitted as a matter of right once the requested variance is in effect. The subject property is nonconforming as to lot size, having area of 4,212# square feet in a district in which a minimum lot area of 5,000 square feet, and as to frontage,-with no street frontage anc~ access obtained over an easement from Shell Street. The subject property (the "Locus"} is situated at 39 SHELL STREET, Siasconset, Assessor's Map 73.1.3, Parcel 5.2, and is shown upon Land Court Plan 17744-B as Lot 2. The Locu$ ig situated in a Residential-1 zoning district. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. The Planning Board recommendation was that the application be withdrawn, as the Planning Board considered that no relief was required. There was no support nor opposition presented at the public hearing. 4. As presented by the applicants, the single-family dwelling upon the Locus was one of several cottages gre-existing the 1955 applicable date of the Subdivision Control Law in Nantucket, and the 1972 applicable date of the Nantucket Zoning By-law, situated upon a single tract of land and known as the "Wade Cottages". In 1979, the then-owner of the tract and cottages thereon caused a plan to be prepared, endorsed by the Nantucket planning Board ae not requiring approval under the Subdivision Control Law, and filed with the Land Court as Plan 17744-B, dividing this tract into eight lots, seven of which contained pre-1955 structures and the eighth of which lies between the coastal bluff and the ocean. Four of these lots, including the Locus, were (and are) nonconforming with the area .requirement of at least 5,000 square feet, and five (also including the Locus) have no road frontage and are served only by easements, thus being nonconforming with the requirement of 50 feet of frontage. Presumably, thi$ plan was endorsed by the Planning Board on the basis that all of the lots (except the one below the top of the bluff) contained pre-1955 structures and thus the plan was exempted from the definition of "subdivision" under the Subdivision Control Law. The applicants then proceeded to purchase the Locus, later in 1979. Meanwhile, subsequent case Iaw and Nantucket practice has made it clear that the exemption of lots so created .from the definition of "subdivision" does not exempt such lots from the pravisions of the Zoning By-law, including area and frontage requirements. Accordingly, the applicants request relief by variance in order to confirm the validity of the Locus as a separate lot for zoning purposes. 5. Based upon the status of the Locus as containing a pre- zoning structure, as do each of the adjacent lots which were in common ownership, the Board of Appeals voted UNANIMOUSLY to grant the requested VARIANCE to confirm and validate the Locus as a separate lot for zoning purposes, which may be used for uses and structures complying with use and dimensional requirements of the Zoning By-law, notwithstanding its nonconformity with area and frontage requirements, finding that owing to circumstances relating to the shape and topography of the locus and the structures thereon, and especially affecting the Locus but not affecting generally the zoning district in which it is situated, a literal enforcement of the provisions of the Zoning By-Iaw would involve substantial hardship to the applicants, and that desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning By-law, subject to the following conditions: ta} All Iteration or construction of buildings upon the Locus shall comply with alI applicable dimensional requirements under the Zoning By-law; and (b) No exterior construction shall take place between May 15 and October 15 in any year. s. Since, by virtue of this- decision, structures and uses complying with the requirements of the Zoning By-law may be . i constructed and used as a matter of right, no relief is required nor granted with reference to the applicants' proposed addition as referenced in the application and notice. Grubbs and Elizabeth G. Grubbs) The subject property (the "Locus") consists of Lot 2 on Land Court Plan 17744-B, containing lot area of about 4212 square feet, and having no street frontage, and improved with a single- family dwelling pre-existing the effective date of the Nantucket zoning by-law in 1972. The Locus is situated in a Residential-1 zoning district, with required lot area of 5,000 square feet and required frontage of 50 feet. Access is over an easement from Shell Street. The dwelling conforms to all applicable setback requirements. The present ground cover ratio is about 15.50; permitted ground cover is 30a. The Locus was in common ownership with other adjacent land, containing several additional cottages, in 1979, when the then owner had a plan prepared, endorsed by the Planning Board as "approval-not-required" under M.G.L., c. 41, §81P, and filed with the Land Court, showing a total of eight lots and with each cottage on a separate lot, several of which did not meet the requirement of 5,000 square feet of lot area, and several of which did not comply with the requirement of 5,000 square feet of frontage. (The plan shows the Locus as containing about 5,565 square feet; however, this is grossly in error, as confirmed by the present plot plan.) The applicants purchased the Locus on December 31, 1979, from the original subdivider. They now request a Variance from the provisions of the Intensity Regulations in Nantucket Zoning By- law §139-16.A, requiring 5,000 square feet of lot area and 50 feet of frontage, in order to ratify, validate and confirm the present conditions upon the Locus. The applicants further desire to construct an addition to the dwelling upon the Locus, which will comply with applicable setback, height and ground cover requirements. HDC-approved plans for this addition are submitted herewith.
