Applicants are seeking a SPECIAL PERMIT under Nantucket Zoning By-Law §139-9B(2)(q). Applicants propose to relocate a trailer to the Locus that would be used for the storage of equipment and/or foam chemicals as may be required by the Nantucket Fire Department. The trailer would meet all dimensional zoning requirements. The Premises is located at 111 WASHINGTON STREET EXTENSION, shown as Parcel #1 on a preliminary subdivision plan currently before the Planning Board, and identified on Assessor's Map 55.1.4, as Parcel 71 (northerly portion). The property is zoned Residential-Commercial. 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the Hearing. The Planning Board made no recommendation as the matter was not of planning concern. There were no letters in the file. 3. Applicants propose to relocate an existing 144+ square-foot trailer, used for the storage of equipment and chemicals required by the Nantucket Fire Department, from a separate lot to the Locus. The trailer is currently situated on a lot owned by the Town of Nantucket and primarily used for public parking. Applicants wish to move the trailer to a more secure environment and enclose it in a fence. Other structures, that will be devoted to marine related activities as may be required by the Nantucket Shellfish and Marine Department, may be constructed in the future upon the Locus. The trailer will meet all dimensional requirements under the Zoning By-Law. 4. Therefore, the Board finds that a grant of relief to allow the ,~ placement of the trailer on the lot would be in harmony with the general purpose and intent of the Zoning By-Law and the placement of the foam trailer at a location proximate the heavily developed downtown area would be a substantial benefit to the inhabitants of Nantucket. 5. Accordingly, the Board, by a unanimous vote, GRANTS the requested SPECIAL PERMIT under Nantucket Zoning By-Law §139-9B(2)(q) to allow placement of the trailer as proposed on the Locus. 6. The Board, by a unanimous vote, approves the Site Plan done by D. Neil Parent, dated May 26, 1997, on file at the Board of Appeals, per Nantucket Zoning By-Law §139-23. Hearing(s) on,/_/ cont'~:~ to,_/_/ _/,^/ withdrawn?~~_ TOWN OF NANTUCKET ZONING BOARD OF APPEALS 37 WASHINGTON STREET NANTUCKET, MASSACHUSETTS 02554 September 30, 1997 David Fronzuto, Marine Superintendent Town Peir Washington Street Nantucket, Massachusetts 02554 Re: Washington Street Extension Boat House and Barn Dear Dave: My initial review of Marine Department's proposed development on Washington Street Extension for compliance with the Town's Zoning By-Law indicates that the Town may construct and use the Boat House, Equipment Barn and Buoy Arbor as a permitted use under Section 139-8A(2) of the By-law. However, the relocation of the Fire Department's foam trailer as an independent structure requires a Special Permit from the Board of Appeals pursuant to Section 139-9B(2)(q). If such a Special Permit is ultimately required, the Board would also be the Site Plan Approval Authority under 139-23. My review is based on information contained on drawings by D. Neil Parent Designer, dated 5/26/97, comprising a proposed site plan, elevations and floor plans. The subject property is zoned Residential-Commercial ("RC") and permitted uses in an RC district under Section 139-8A includes: (2) Any municipal use including, but not limited to, offices, schools, parks, libraries and recreation uses. It would appear that the uses you described to me, i.e. the maintenance and storage of town owned boats and other marine equipment in or outside the Boat House; r the storage oil booms and Town Biologist supplies and equipment in the Barn; the Fire Department's foam trailer; and the storage of town owned buoys on the Buoy Arbor, would be a municipal use of a town charged with managing harbors and waterways. However, the use the foam trailer as assessory building is only allowed by Specia! Permit, but if the trailer is housed inside a building a Special Permit does not seem to be required. The proposed plot plan shows structures meeting all dimensional requirements of the Zoning By-Law, save for the off-street parking requirements set forth in §139-18. By my calculation, the Boat House covers ±960 SF and the equipment barn covers ±320 SF, for a total of +1280 SF. Classifying these proposed municipal uses as "warehousin or other business uses" under §139-18, two (2) ofl=street parking spaces would be required. The ground cover of the foam trailer (not detailed in the plans) should probably be added into the parking calculation which may increase the number of parking spaces required to three (3) spaces. While no parking spaces are shown on the proposed plan, there appears to be plenty of room for more than enough parking on the property as configured. I hope your find this analysis helpful.
