At a Public Hearing of the Nantucket Zoning Board of Appeals held
at 1:00 P.M., Friday, June 12, 1998, in the Conference Room, in the Town
Annex Building,. 37 Washington Street, Nantucket, Massachusetts, on the
Application of SAMUEL BAILEY, JR. AND JANET BAILEY, TRUSTEES OF MILL
STREET REALTY TRUST, of 211 Mountain Spring Road, Farmington, CT 06032,
Board of Appeals File No. 058-98, the Board made the following Decision:
1. Applicants are seeking a SPECIAL PERMIT under Nantucket Zoning
By-Law §139-18B(1) to permit one (1) parking space for Applicants'
secondary dwelling to be located off-site on the abutting parcel, also
owned by the Applicants, which contains their principal single-family
dwelling and detached garage. Applicants own two. (2) adjacent lots with
the parking space for the main dwelling being located in front of the
garage on Lot 1. Applicant is in the process of constructing a secondary
dwelling on Lot 2 with the proposed parking space being located next to
the existing parking space on Lot 1.
The Premises is located at 11 MILL STREET, Assessor's Map 42.3.3,
Parcel 32 and Assessor's Map 55.4.4, Parcel 14, Plan Book 386, Page 135.
The property is zoned Residential-Old-Historic.
2. The Decision is based upon the Application and the materials
submitted with it and the testimony and evidence presented at the
Hearing. The Planning Board made no recommendation as the matter was not
of planning concern. There were four (4) letters on file in favor of the
Application.
3. Applicants, through counsel, represented that Applicants own two
(2) adjoining lots on the corner of Mill Street and New Dollar Lane. The
existing main single-family dwelling and garage are located on Lot 1 with
the parking space for said dwelling being located in front of the garage
on Lot 1. The Applicants are in the process of constructing a secondary
dwelling on the adjoining Lot 2 with the proposed access to the secondary
dwelling to be across from the parking area on Lot 1. Applicants would
like to provide the required second parking space for the secondary
dwelling on on Lot 1 proximate to the existing conforming parking space
in front of the garage. Applicants further represented that though the
Lots could be sold out of common ownership and meet all zoning
requirements, they had developed the two (2) Lots as one (1) cohesive
property with the majority of Lot 2 having been cultivated as an
extensive garden. If a parking space was required to be located on Lot 2
it would necessitate taking up a portion of the established garden, with
the removal of a picket fence, trees and flower beds. Applicants also
stated that allowing both parking spaces to be located on Lot 1 would
further the goal of developing the two (2) Lots into a unified property.
4. Therefore, the Board finds that the provision of the one (1)
required parking space for the secondary dwelling on Lot 2, off-site on
Lot 1 as proposed would be in harmony with the general purposes and
intent of the Zoning By-Law and not be contrary to sound traffic and
safety considerations. The Board further finds that there are practical
difficulties with locating the required parking space on Lot 2 and the
Board has the power to grant a Special Permit to allow the use of
off-site premises to meet all or a portion of the required off-street
parking. Maintaining the existing garden would provide a benefit to the
neighborhood, preserving a substantial open green space in what can be
considered a densely settled portion of the Town of Nantucket.
5. Accordingly, by a unanimous vote, the Board GRANTS the requested
relief by SPECIAL PERMIT under Nantucket Zoning By-Law §139-18B(1) to
allow the one (1) required parking space for the secondary dwelling on
Lot 2 to be located on Lot 1 as proposed and shown on the plan done by
John Shugrue, dated June 8, 1998, marked as Exhibit A and attached
hereto, upon the following condition:
- Applicants, or their successors in title, shall maintain the
parking space for Lot 2 as described above, until such time as the Lots
are conveyed out of common ownership, at which time one (1) on-site
parking space shall be provided upon Lot 2 to meet the parking requirement
for any dwelling contained therein.
