Incorrect information was presented by oversight at the original Public Hearing as to correct square footage of the proposed structure. The Board feels that this constitutes a minor clarification rather than a Modification which would necessitate a fully noticed Public Hearing. Applicant has indeed built to the Certificate of Appropriateness No. 32216 granted by the Historic District Commission and conditioned by this Board in our Decision. As the matter is a Clarification it does not have a twenty {20) day appeal period associated with it. In conclusion, in the Decision issued in File No. 057-98, where there is a reference to "950+~~ square feet", the Decision should read "up to 1275+ square feet". There is no need to change the actual Decision text itself. This letter should be filed with the Decision as an addendum. Thank you for your attention to this matter. It seem$ that the original ground cover: 950 t square feet, provided to the Board and included In the Decision, was erroneous. It is my hope that you can clarify the Decision and make the necessary corrections In order for the Decision to correctly reflect the actual ground cover. The original dwelling on my lot was 1,330 square feet. In the Board of Appeals Flle #042-96 a ground cover of 1,550'} square feet was approved. As modified in the Board of Appeals Decision # 057-98 the ground cover was stated to be 950 square feet. Actually, the new dwelling wilt have a finished ground cover of no mare than 127.5~quare feet. The new dwetitng is being built In conformance with Certificate of Appropriateness # 32216-Issued by the Historic District Commission and referred to fn the Board of Appeals Decision # 057-98. It is substantially sited in the same location as the original dwelpng. Please note that the total S.F, of the proposed new dwelling is still less than the original dwelling. Applicant is seeking a MODIFICATION of the SPECIAL PERMIT issued in the BOA Decision in File No. 042-96 to allow the demolition and reconstruction of a single-family dwelling. The Premises is one (1) of three (3) units of the Gardner Condominium, which consists of two (2) merged lots containing a total of 211,840+ square feet of area. In File No. 042-96, Applicant was granted relief to renovate, alter and expand the exiting dwelling and increase the ground cover from 1,230+ square feet to 1,550+ square feet. Applicant now seeks the Modification to permit the demolition and reconstruction of the dwelling, to be sited in substantially the same location as the existing structure with a ground cover of 950+ square feet. The Locus is non-conforming as to frontage, having 25.38+ feet of frontage along Hummock Pond Road where a minimum frontage of 75 feet in the R-2 district and 150 feet in the LUG-2 district is required; and as to number of dwelling units on one (1) lot, with the Lot containing three (3) dwelling units where a maximum of two (2) are allowed per lot. See also BOA File Nos. 043-96 and 044-96. The Premises is located at 195 - 197 HUMMOCK POND ROAD, Assessor's Map 65, Parcels 23 and 24, Plan File 47-0, Land Court Plan 28915-A. The property is zoned Limited-Use-General-2 and Residential-2. 2. The Decision is based upon the Application and material submitted with it and the testimony and evidence submitted at the Hearing. The Planning Board made an unfavorable recommendation. There were two (2) letters on file in favor of the Application. 3. Applicant, through counsel, represented that in the Decision, issued by the Board of Appeals in File No. 042-96, a Special Permit was granted to renovate, alter and expand the single-family dwelling known as Unit No. 1, by increasing the existing ground cover of 1,230+ square feet to 1,550+ square feet without necessitating demolition of that structure. Since issuance of that Decision Applicant has ascertained that it would be more cost-effective and practical to replace the existing structure in its entirety. Applicant now wished to demolish or remove from the property the existing structure and construct a smaller single-family dwelling with a ground cover of up to 950+ square feet. It would be sited substantially in the same location as the existing dwelling. A modification of the previous Decision in File No. 042-96 was needed to allow the demolition or removal of the existing dwelling and construction of a new dwelling. The existing structure conformed in all respects with the dimensional requirements of the Nantucket Zoning By-Law as will the new dwelling. Applicant represented that the non-conforming use, i.e., three (3) dwelling units on one (1) lot, would not be abandoned with the demolition and reconstruction occurring simultaneously as one (1) project. There were three (3) separate dwelling units on the Lot and there would be three (3) dwelling units on the Lot after the demolition or removal and reconstruction. 4. Therefore, the Board finds that the demolition or removal of the existing structure and reconstruction of a new smaller single-family dwelling will not be substantially more detrimental to the neighborhood than the existing non-conformities. Applicant is not abandoning the non-conforming use of the Premises by the replacement of the structure as there are currently three (3) separate dwelling units on the Lot and there will continue to be three separate (3) dwelling units with the demolition or removal and reconstruction occurring as part of the same project. The Board further notes that there will be less ground cover than allowed in the previous Decision and the new structure will conform with all dimensional zoning requirements, thus not increasing any existing non-conformities of the Locus. 5. Accordingly, by a unanimous vote, the Board GRANTS the requested MODIFICATION of the Decision issued in Board of Appeals File No. 042-96 in which a SPECIAL PERMIT was granted, to now allow demolition or removal of the existing single-family dwelling known as Unit No. 1, and construction of a new up to 950+ square-foot single-family dwelling, without loosing the grandfathered status of the Locus, upon the following conditions: a. The structure shall be constructed in substantial conformance with Certificate of Appropriateness No. 32216 issued by the Nantucket Historical Association; and b. ADDENDUM TO ZONING BOARD OF APPEALS APPLICATION FOR GALEN ANN GARNDER The Applicant seeks a Modification of Special Permit No. 042-96 under Section 139-33A of the Nantucket Zoning Bylaw to allow the demolition of an existing single family dwelling and construction of asingle-family dwelling in its place on Premises known as Unit No. 1 of the Gardner Condominium. The Premises is one of three units of the Gardner Condominium, that consists of two merged lots, containing 211,840± square feet of area. The Premises is non-conforming as to frontage, having 25.38 feet of frontage on Hummock Pond Road, where 75 feet of frontage is required in the R-2 district and 150 feet is required in the LUG-2 district. The Premises is also non- conforming as to the number of dwelling units on one lot, containing three (3) dwellings that have existed on this property since prior to 1972, where the zoning district permits a maximum of two (2) dwelling units per lot. For Applicant's title, see Unit Deed recorded in Book 509, Page 87 at the Nantucket Registry of Deeds. The Premises is located at 195-197 Hummock Pond Road, Assessor's Map 675, Parcels 23 and 24, Plan File 47-0, and Land Court Plan No. 28915-A. The property is zoned Residential -2 and Limited Use General - 2. The majority of the Premises (including the portions containing all of the improvements) is zoned Residential-2. The condominium site plan, a reduced copy of which is attached as Exhibit A, shows the location of the zoning boundary line. The Nantucket Zoning Board of Appeals granted special permit relief in Board of Appeals File No. 042-96 to renovate, alter and expand the dwelling on Unit No. 1 from the existing ground cover of 1,230± square feet to 1,550± square feet. The Applicant seeks a modification of Special Permit No. 042-96 to permit the demolition of the existing dwelling and construction of a new dwelling, to be located in substantially the same location as existing dwelling with a ground cover of approximately 950± square feet. A floor plan showing the existing and the proposed footprint of the dwelling is attached as Exhibit A. The condominium site plan, annotated to show the location of the new structure, is attached as Exhibit C. The existing dwelling and the proposed dwelling both conform in all respects with the dimensional requirements of the Nantucket Zoning By-Law. The non- conforming use (three dwellings on a lot) is not being abandoned because the demolition and reconstruction will occur simultaneously as one project. Therefore, relief is available to the Applicant by special permit. The demolition of the existing dwelling and construction of a new dwelling will not be more detrimental to the neighborhood that the existing non-conformities, because the proposed new dwelling will be in the same location with ground cover of approximately 950± square feet, less than both the existing structure (1,230± square feet) and the ground cover permitted in the Special Permit No. 042-96 (1,550± square feet) for the previously proposed renovation.
