At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, June 12, 1998, at 1:00 P.M., in the Conference Room, in the Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, the Board made the following decision on the application of JEFFREY S. RUBIN and CYNTHIA A. RUBIN, c/o Reade, Gullicksen, Hanley & Gifford LLP, Post Office Box 2669, Nantucket, Massachusetts 02584, File No. 055-98: 2. The applicants request relief by SPECIAL PERMIT under Nantucket Zoning By-law §139-33.A(4), or in the alternative relief by VARIANCE pursuant to Nantucket Zoning By-law §139-32 from the Intensity Regulations of Zoning By-law §139-16.A (ground cover). The applicants propose to enclose 117± square feet of an enclosed first-story deck, now situated partially under a second floor deck, without coming any closer to the rear yard lot line than is the existing single-family structure. The current ground cover ratio is 28.1%±, and with the new addition the total ground cover ratio would be 30.60±, in a district where maximum ground cover for undersized lots is 30% for undersized lots. The subject property is nonconforming as to lot size, having area of 4580± square feet, with minimum lot area in the district being 5,000 square feet; as to side and rear yard setbacks, with the structure being sited 1± foot at its closest point from the westerly side yard lot line and 1± foot at its closest point from the rear yard lot line, in a district where the minimum side and rear yard setback is five feet; and as to parking, with no spaces provided on-site. The applicants also seek a SPECIAL PERMIT under Nantucket Zoning By-law §139-18.B(2) and (3) (parking requirements) to waive the one parking space required by reason of the enlargement of the dwelling. No space is currently provided and none is planned after construction of the. addition. See also Board of Appeals File No. 041-91. The subject property (the "Locus") is situated at 73 MAIN STREET, Assessor's Map 42.3.1, Parcels 153 and 227, is shown on plan recorded with Nantucket Deeds in Plan Book 22, Page 8, as Lot 1, and is zoned as Residential-Old Historic. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. The Planning Board recommendation was favorable as to the requested parking relief; the Board made no recommendation as to the requested increase in ground cover on the basis that no planning issues were raised. There was no opposition presented at the public hearing; one direct neighbor expressed her support for the parking relief so long as no increase in ground cover to exceed the maximum ratio of 30% were proposed. 4. At the public hearing, the applicants informed the Board of Appeals that they had done further planning, and that with the assistance of their architect had been able to work out a plan for the enlargement of their dwelling as desired, without increasing ground cover over the 30o allowed for a lot containing less than 5,000 square feet. Accordingly, they requested that their application for relief in connection with increase of ground cover in excess of 300 of lot area be withdrawn, without prejudice. However, they do intend to construct a small addition to the dwelling, and under Nantucket Zoning By-law §139-18.A(1) any enlargement of a building invokes the requirement that parking be provided for the enlarged building as if it were newly constructed. The Locus does not contain an on-site parking space, and none could be provided without removing an attractive fence and placing the parking space in what is now an attractive garden. Furthermore, the result of providing such a space would be to eliminate an existing on-street parking space in Main Street, and no increase in the number of required parking spaces (one, for the single dwelling unit) would result from the proposed work. 5. Accordingly, by unanimous vote, the Board of Appeals first found that the requested special permit for parking relief was in harmony with the general purpose and intent of the Zoning By-law, and that compliance with the parking requirements of the By-law would have a significant and adverse effect upon the scenic or historic integrity of the neighborhood and would be contrary to sound traffic and safety considerations, and hence voted to grant the requested SPECIAL PERMIT under By-law §139- 18.B(2) waiving the provision of the single parking space which would be required for the enlarged dwelling upon the Locus, as permitted in the Resident Parking Permit District by §139- 18.B(3), provided that the ground cover ratio of the enlarged structure shall not exceed 300. Further, by unanimous vote, the Board of Appeals approved the applicants' request to withdraw without prejudice their application for relief to increase the ground cover ratio to more than 300. RUBIN AND CYNTHIA A. RUBIN ~ 3~- ~~ a~ The applicants request relief by Special Permit under Nantucket Zoning By-law §139-33.A(4), or in the alternative a Variance from §139-33.E(2)(a) (Ground Cover for Lots Under 5,000 Square Feet in Area), in order to enclose an area of first-story deck now situated under a second-story deck and thus arguably constituting an unenclosed porch. The subject lot contains about 4,580 square feet, in a district where minimum lot area is 5,000 square feet. The pre-existing single-family dwelling situated upon the locus is nonconforming as to side and rear yard setback, being sited about one foot from the westerly side lot line and about one foot from the rear lot line; no portion of the structure within the required five-foot setback will be affected. Present ground cover, with the area to be enclosed being treated as an unenclosed porch, is about 28.10; the addition of 117 square feet of ground cover, within the existing footprint, is proposed, which will result in ground cover of about 30.60. Prior to the amendment to the By-law excluding unenclosed porches from the calculation of ground cover, the area in question was included in ground cover, resulting in the same ground cover ratio of about 30.60 which is now proposed. In Case No. 041-91, the Board of Appeals granted variance relief to confirm the validity of the locus after prior conveyance of a small strip to an abutter. The applicants also request Special Permit relief under §139- 18.B(2), as permitted in the Resident Parking Permit District by §139-18.B(3), to waive the one parking space required by reason of the enlargement of the dwelling by virtue of §139-18.A(1), on the basis that compliance with the requirement to provide an off- street parking space upon the locus would be physically impossible for the applicant to provide, or if physically practical, would have a significant and adverse effect upon the scenic or historic integrity of the neighborhood, or would be contrary to sound traffic and safety considerations.
