At a Public Hearing of the Nantucket Zoning Board of Appeals held
at 1;QO P.M., Friday, June 12, 1998, in the Conference Room, in the Town
Annex Building, 37 Washington Street, Nantucket, Massachusetts, on the
Application of NEW ENGLAND TELEPHONE/BELL ATLANTIC, OWNER AND FOR NEXTEL
COMMUNICATIONS OF THE MID-ATLANTIC, INC., DBA NEXTEL COMMUNICATIONS, INC.
LESSEE, of 125 High Street, Boston, MA 02110 and 40 Hartwell Avenue,
Lexington, MA 02173, respectively, Board of Appeals Fiie No. 054-98, the
Board made the following Decision:
1. Applicant (Nextei) is seeking a MODIFICATION of a SPECIAL PERMIT
issued in the BOA Decisions in File Nos. 071-90 and 044-91 and a SPECIAL
PERMIT under Nantucket zoning By-Law §139-33A (altzration/expansion of a
pre-existing non-conforming structure/use). Applicant proposes to mount
twelve (12) antennas at the I40' mark on an existing 220'
telecommunications tower. A 10' x 20' radio equipment shelter would be
placed next to the existing equipment building. The new antennas would
provide additional mobile telecommunications services to the Island. The
Locus is non-conforming as to height limitations with the existing tower
exceeding the 30~foot maximum height allowed; and as to use.
The Premises is located at 14 EEL POINT ROAD, Assessor's Map 40,
Parcel 64, Plan Book 16, Page 46. The property is zoned
Limited-Use-General-2.
2. The Decision is based upon the Application and materials submitted
with it and the testimony and evidence presented at the Hearing. The
Planning Hoard made a favorable recommendation as the existing tower
would be used and no new tower constructed for the proposed use. There
were no letter on file in support or opposi~ion.
3. Applicant represents that the existing 220' communications tower
was constructed in 1966 prior to the 1972 enactment of the Zoning By-Law.
The tower also exceeds the maximum allowable height in the LUG-2 Zoning
District and communications towers are not a permitted use in said zoning
district. Therefore, both the structure and use are validly
grandfathered, pre-existing and non-conforming. The proposed wireless
telecommunications installation will not increase the non-conforming
height of the existing tower nor have a visual impact upon the Character
of the surrounding neighborhood being placed at an elevation of 140' on

the tower. The Nextel facility will consist of three {3) separate mounts
of four (4 `, panel antennas that ;1ili measure about six (b) feet in
length, about six (6) to eight {8) inches wide and 8.5 inches in
thickness. Applicant further represents that the radio frequency
emissions from the installatian will be completely safe, emitting ar.
average of 25 watts with the maximum output being 100 watts, with no
microwaves transmissions. Application to the State Department of Public
health has been made. An approximately 10' x 20' building, 10' in height,
will be constructed next to the existing structures, to shelter ancillary
radio equipment and bark-up systems. The tower and Shelter, located in
the center of the 11.7 acre parcel, will be surrounded by a 250' buffer
of existing mature vegetation and the e~cisting 12' wide unpaved road will
continue to be used for access to the site. Applicant states that a
Certificate of Appropriateness too. 3eZ~lS~ , has been issued by the
Nantucket Historic District Commission.
4. Therefore, the Roard finds that Nextel's proposed
telecommunications installation is similar to those recently approved by
the zoning Board of Appeals for other licensed wireless phone carriers in
the area. Since the proposal consists of utilizing an existing tower and
construction of a small equipment shelter set back on a large lot, with
no discernible public health impact, the Board further finds that the
proposed installation and Construction of the shelter would not be
substantially more detrimental to the surrounding neighborhood. There
would be little traffic generated to the site and the Modification of the
Decisions issued in BOA File Nos. 071-90 and 0~4-91 would be in harmony
with the general purpose and intent of the By-Law.
5. Accordingly, by a unanimous vote, the Board GRANTS the requested
MODIFICATION of the SPECIAL PERMITS issued in the becisions in BOA File
Nos. 071-90 and 044-91 and a SPECIAL PERMIT under Nantucket Zoning By-Law
§139-33A to mount up to 12 antennas at approximately .40' mark on the
existing 220" telecommunications toctier and construct an up to 10' x 20'
radio equipment shelter upon the following condition:
- The shelter shall be constructed in substantial compliance
with the Certificate of Appropriateness No. ,3 e2 /S~- issued by the
Nantucket Historic District Commission. ~ ! r

Dear Mr. Waine:
Nextel Communication of the Mid-Atlantic Inc. (Nextel) hereby requests an amendment to Special
Permits # 071-90 and 044-91, for a wireless telecommunications installation on the existing tower
located at 14 Eel Point Road. The 11.7 acre parcel is identified on the Assessor's map as map 40
lot 64. The land is owned by New England Telephone /Bell Atlantic. A letter from the land
owner, Bell Atlantic, authorizing the use of the tower is enclosed for the record. Also enclosed
please find:
• Four (4) full size sets of site plans
• Two (2) 11" X 17" sus of site plans
• Check for $200 -Filling Fee
• A copy of Nextel's FCC License
The State D~artment of Public Health (DPH) application and the structural report on the tower
for the proposed additional antennas are being completed, they will be submitted prior to the public
hearing.
Nextel Communications proposes to mount 12 panel antennas on the existing 220' tower. Anew
prefabricated 200 sq./ft equipment shelter will house the wireless telecommunications radio
equipment. A propane powered back up generator will provide electricity during power failures.
Background on Nextel
Nextel has been providing mobile services to the Massachusetts Market for approximately two
years. Nextel is now in the process of continuing its seamless wireless telecommunications
services to the Cape & Islands region for both residential and commercial uses. Nextel is fully
licensed by the Federal Communications Commission (FCC) to operate their Enhanced Special
Mobile Radio (ESMR) system in the New England region. The Nextel system is very different
from the traditional cellular phones that have been in the area for the past ten to fifteen years. The
ESMR system allows the user to utilize their digital cell phone not only as a telephone, but also as
a hand held radio. In addition to municipal and business applications, Nextel also intends to
provide coverage for the residential uses of their system.
Zoning Comuliance
The Bell Atlantic tower was constructed in 1966, prior to the town's adoption of the Zoning
Bylaw. The tower also exceeds the maximum allowable height in the LUG-2 Zoning District.
Communications towers are not a permitted use in the LUG- 2 Zoning District, therefore both the
structure and the use are grandfathered, pre-existing and non-conforming.
Section 139-33-4 (a) of the Zoning Bylaw allows the Board of Appeals to grant a Special Permit
for extending or altering apre-existing nonconforming structure or use if the Board makes a
finding that the alteration or extension will not be substantially more detrimental to the
neighborhood
Nextel's proposed wireless telunications installation will not increase the non-conforming
height of the existing tower. Mounting antennas on the tower is consistent with the use of the
structure as approved by the ZBA for the existing Special Permits on the property. The following
information explains the proposed installation and demonstrates that the proposed alteration of the
tower will not be substantially more detrimental to the surrounding neighborhood
Proposed Wireless Communications Equipment Installation
The proposed installation co-locates Nextel's equipment on an existing tower used by other
telecommunication carriers. This approach to telecommunications installations is consistent the
towns goals of preserving its historic community character because it minimizes the number of new
towers needed in Na~rtucket. By taking this approach, Nextel can provide their services to the
towns businesses, residents and visitors with the least visual impact on the community.
The Nextel facility will consist of three (3) separate mounts of four (4) panel antermas located at
elevation 140' on the tower. Each grouping of four arrtennas will be oriented in different
directions, the first group will face a cor~ass reading of 0 degrees, the second will face a bearing
of 120 degrees and the third will face a bearing of 240 degrees. Due to this sites location on the
island, the above orientations of anrermas may be slightly ad3usted The panel anteimas will be
connected to coaxial cable that will run down the tower to the wed radio equipment shelter.
Panel Auteunas
The panel antelmas measure approximately 6 feet in length, and are approximately 6 to 8 inches
wide and 8.5 inches in thickness or depth. Each panel weighs approximately ten powids. They are
manufactured from a fiberglass polymer. The Nextel antennas operate in the designated range
allotted by the (FCC). Nextel's effective broadcasting range in the Cape & Islands area is between
806 MHz and 824 MHz receiving and 851 MHz and 869MHz transmitting. This range is a former
VHF frequency that had never been utilized by the television broadcasting industry.
Radio Equipment Shelter
The shelter is prefabricated off site and is designed to meet the Massachusetts State Building Code
and is certified by a Massachusetts Registered Professional Engineer. The building is
approximately ten feet (10') in height. The tower and shelter will be surrounded by a 250' buffer of
existing mature vegetation and will not be visible from the surrounding properties or roads. The
shelter will rest on a concrete flooring slab that measures 10'X 20' and will be poured on the site
next to the existing building. The shelter will be famished with a cooling system to prevent the
radio equipment from overheating.
Screening
The existing tower and equipment buildings are located in the center of the 11.7 acre parcel. The
developed portion of the lot is surrounded by existing, mature vegetation. A 250' vegetated buffer
currently exists around the telecommunications installation. We propose to make our installation
within the area of existing developmecrt, with out altering existing vegetation on the site. Due to
the existing buffer, we do not propose any additional landscaping.

Access Road
The existing 12' wide unpaved access road will be used There are no additional access roads
proposed
Public Safety
The tower and equipment buildings are enclosed by a 6' chain link fence. The equipment shelter
will be completely secured with a locking mechanism to ensure the safety of the community as well
as protecting the radio equipment. The radio frequency emissions from the installation will be
completely safe, emitting an average of 25 watts, the maximum output will be 100 watts. The
instillation is regulated by the State Department of Public Health (DPH). A copy of our DPH
application will be provided for your records.
Construction Techniques & Schedulinst
Nextel's telecommunication installation will be done in a good workman like manor, following
industry standards and all applicable Federal, State and Local laws. Nextel plans to install the
equipment as soon as all necessary approvals are in place.
Traffic Generation
Nextel's radio equipment inside the equipment shelter will be serviced once a month. The panel
a~ennas will be serviced less frequently on an as needed basis. Therefore the proposed installation
will generate very little traffic in the area.
Public Need & Benefits
Mobile phones have been growing in popularity and provide numerous benefits to the public. They
have proven to be very useful for business uses, enabling communication to take place anywhere at
any time for business transactions. Wireless, digital mobile phones have also grown in popularity
and are used by many people as a convenience for personal use, keeping family members and
friends in touch with one an other. The most important use of mobile phones are for emergencies.
For these reasons the Massachusetts State Department of Public Utilities (DPU) has granted
Nextel Communications Public Utility status.
Summary
Nextel's proposed telecommunications installation is similar to those recently approved by the
Zoning Board of Appeals for other licensed wireless phone carriers in the area. Since our proposal
consists of utilizing an existing tower and construction of a small equipment shelter set back on a
large lot, the proposed installation will not be substantially more detrimental to the surrounding
neighborhood. There is very little traffic generated, as the site will only be serviced once a month.
There will be no sanitary faalities and therefor no adverse impact to groundwater. For these
reasons there will be very little impact on the community and surrounding neighborhood, therefore
we request that the Board of Appeals approve this Special Permit request.

thereof, have our full authority and consent to seek approval from Nantucket Board of Appeals for a
