At a Public Hearing of the Nantucket Board of Appeals held at 1:00
P.M., Friday, June 12, 1998, in the Conference Room, in the Town Annex
Building, 37 Washington Street, Nantucket, Massachusetts, on the
Application of NORMA MINSTRELL AND NANCY CHASE, OWNERS AND FOR NANCY
CHASE, of 6 Cobble Court, Nantucket, MA 02554, Board of Appeals File No.
053-98, the Board made the following Decision:
1. Applicant (Chase) is seeking a SPECIAL PERMIT under Nantucket
Zoning By-Law §139-33A (alteration/expansion of a pre-existing
non-conforming use/structure). Applicant proposes to construct a 54+
square-foot addition that would provide an entry-way into an existing
exterior door. The addition would enclose a portion of an existing deck
located on the southerly side of the single-family structure that is
situated within the required 30-foot front yard setback area, with the
addition coming no closer to the front yard lot line along Tennessee
Avenue than the existing structure. The Locus is non-conforming as to lot
size with the Lot having an area of 19,300+ square feet in a district
that requires a minimum lot size of 20,000 square feet; as to front yard
setback with the structure being sited 15.8+ feet at its closest point
from that lot line with an outdoor shower being sited slightly closer;
and as to side yard setback with a shed being sited 5.1+ feet at its
closest point from the northeasterly side yard lot line in a district
that requires a minimum side yard setback of ten (10) feet.
The Premises is located at 50 TENNESSEE AVENUE, Assessor's Map
59.4, Parcels 93 and 200, Land Court Plan 3092-S, Lots 135 and 135A. The
property is zoned Residential-2.
2. The Decision is based upon the Application and the materials
submitted with it and the testimony and evidence presented at the
Hearing. The Planning Board made no recommendation as the matter was not
of planning concern. There were no letters on file.
3. Applicant represented that the single-family dwelling was
constructed in March of 1972 with the shed having been completed in 1978
or 1979. Both structures were built pursuant to duly issued Building
Permits and an Order of Conditions issued by the Nantucket Conservation
Commission, and in compliance with the Zoning By-Laws as they existed at

•the time of construction. Applicant now wished to enclose a 54+
square-foot section of an existing open deck to provide an entry-way into
the dwelling. The addition would be located almost entirely within the
required 30-foot front yard setback area but would be sited farther away
from said lot line than the existing structure.
4. Therefore, the Board finds that the construction of the 54+
square-foot addition as proposed would increase the non-conforming nature
of the structure with the addition being sited within the required
30-foot front yard setback area but would not be substantially more
detrimental to the neighborhood than the existing non-conformities,
as it would come no closer to that lot line, contained within the
existing footprint and have a de minimus impact.
5. Accordingly, by a unanimous vote, the Board GRANTS the requested
relief by SPECIAL PERMIT under Nantucket Zoning By-Law §139-33A to allow
construction of a 54+ square-foot addition to provide an entry-way into
the existing single-family dwelling upon the following condition:
- The addition shall be built in substantial conformity with
the plan dated April 8, 1998, done by Nantucket Surveyors, Inc., marked
as Exhibit A and attached hereto.

This Determination does not relieve the applicant from complying with all other applicable federal, state or {oval statutes, ordinances,
by-laws or regulations. This determination shall be valid for three years from the date of issuance.
The applicant, the owner, any person aggrieved by this Determination, any owner of land abutting the land upon which the proposed
work is to be done, or any ten residents of the city or town in which such land is located, are hereby notified of their right to request
the Department of Environmental Protection to issue a Superseding Determination of Applicability, providing the request is made by
certified mail or hand delivery to the Department, with the appropriate filing fee and Fee Transmittal Form as provided in 310 CMR
10.03(7), within ten days from the date of issuance of this Determination. A copy of the request shall at the same time be sent by
cert'rfied mail or hand delivery to the Conservation Commission and the applicant.
