INC. MODIFICATION OF SPECIAL PERMIT The Applicant, Sankaty Head Golf and Beach Club, Inc., seeks to modify Special Permit No. 045-90 pursuant to §139-33A of the By-law to remove and/or demolish a "cabana" structure at the Beach Club with approximately 337± square feet of ground cover; to relocate an existing shed known as "The Hut" at the Sankaty Tennis Courts, and to construct a new building at the Sankaty Tennis Courts with a ground cover of approximately 360 square feet. In its prior Special Permit Decision No. 45-90, this Board found that the Beach Club and tennis use of the property was apre-existing, non-conforming use and the structures on the property had apre-existing, non-conforming aggregate ground cover of 8,884 square feet. In its Special Permit Decision of December 18, 1997 (No. 066-97), this Board found that the present count of commercial structures constructed on the Sankaty Golf Club property at 100 Sankaty Road and the Sankaty Beach Club property at 18 Hoicks Hollow Road which were constructed since 1979 had an aggregate ground cover of 3,770 square feet and, therefore, did not cross the 4,000 square foot major commercial development special permit threshold imposed by §139-11 of the By-law. The Applicant proposes to remove and/or demolish a cabana structure from the Beach Club with a ground cover of approximately 337 ± square feet. The Applicant also seeks permission to relocate a small tennis shed to the southeastern corner of the Sankaty tennis courts and to use this shed for storage purposes. Finally, the Applicant seeks permission to construct a new structure ancillary to the tennis courts with a ground cover of approximately 360 square feet. If the project is approved, the Applicant will increase the existing ground cover of the structures by approximately 22'/z square feet and the new, aggregate ground cover of commercial structures constructed on the entire Sankaty Golf and Beach Club property since 1979 will be 3,792.50± square feet, less than the 4,000 square foot major commercial development special permit threshold. Applicant is seeking relief by Special Permit pursuant to Section 139-7D(4) of the Nantucket Zoning By-Law to expand an existing dormitory that was permitted by variance on June 10, 1983, Board of Appeals File No. 22-83. The dormitory, known as Fleming Hall, presently provides sleeping quarters for ten (10) persons and the applicant seeks a special permit to expand that facility to sleep eighteen (18) persons by reconfiguring the interior of the building, and by adding a wing, for a total additional ground cover of 956 square feet. 2. The premises are located at 100 Sankaty Road, Siasconset, Massachusetts, Assessor's Map 49, Parcel 02, Land Court Plan 9548C, Lot 2A, Certificate of Title No. 1308. The property is zoned LUG-3. 3. The DECISION is based upon the application and materials submitted with it and the testimony introduced the hearings. There were no letters in the file. The preliminary focus of the Board was of a jurisdictional nature. The question reviewed was whether applicant had crossed the 4,000 square foot commercial structure or use threshold imposed by Section 139-11 of the Nantucket Zoning By-Law. Crossing the threshold would put the project in the major commercial development category, jurisdiction over which is confined to the Planning Board. The applicant presented a letter to the Board analyzing the commercial structures that have been built and removed at the Club since 1979. In the case of applicant, the present count of commercial structures is 3,770 square feet and the MCD threshold has not yet been reached. Accordingly, jurisdiction remains with the Zoning Board of Appeals. 4. The Planning Board submitted its comments on November 18, 1997 which recommended approval of the site plan subject to certain conditions, some of which were adopted by the Board in its vote. 5. The site plan showing elevations, the structure, additions, parking and the relative position of Fleming Hall was approved by unanimous vote of the Board although the applicant could have done a better job in presentation of the information. The Board recognized that site plan review is a relatively new procedure but made it clear to the applicant that on future applications more exacting standards would have to be met. 6. The Board fords that expanded on-site housing for seasonal employees is in the best interests of the community and that the addition is harmonious with all of the dimensional and intensity regulations of the code, as well as the general purpose and intent of the Nantucket Zoning By-Law. In granting the requested relief, however, the Board requires. that the applicant provide ten (10) additional parking spaces adjacent to Fleming Hall and a bicycle rack containing not less than nine (9) slots for bicycles. 7. FOR ITSELF AND FOR MRS. ARTHUR DEAN (045-90), Box 293, Siasconset, MA 02564. 1. Applicant seeks SPECIAL PERMIT relief pursuant to SECTION 139-33A to relocate five (S) buildings on the lot owned by Sankaty Head Heath Club and within the Beach Club's Easement Area (the •Easement Area") of the abutting )ot on the northerly side owned by Mrs. Arthur Dean, to remove• two (2) buildings from tFe Beach Club lot entirely and to relocate one of the buildings at the same non-conforming side line setback of one of the removed buildings. Further, Applicant seeks a VARIANCE from the SECTION 139-16A requirement of a ten (!0) foot rear ani side line setback for lots of record to alloy one of the relocated buil~lings to straddle the lot line running between the northerly bound oC the Desch Club property and the Easement Area. The premises are located at 18 HOICKS HOLLOW ROAD, Siasconset, Assessor's Map and Parcel 23-9 and 23-8 for the Easement Area. The Applicant operates a private Beacli Club on the premises as a pre- exiatinq, non-conforming use in the LUC-3 zone. 2. Our findings are based upon the application papers, site plane shoving the existing (our Exhibit "A") and proposed relocation and removal (our Exhibits "B" and "C°) on file, and representations and testimony received at our hearing. A letter from Mrs. Arthur Dcan shoving leer consent to the proposed project was received at the hearing. No one appeared at tine hearing in opposition. . . 3. We find that Special Permit relief to remove two (2) buildinq~ and relocate the required five (5) buildings is an alteration of the pre- exi.sting, non-conforming use of the premises that will not be substantially • more detrimental than the existing non-conforming use to the neighborhood. In fact, the pre-existing non-conformity as to ground cover, 8884 square feet existing with 4094.70 allowable, will be reduced by 2760 square feet due to the removal of the two buildings. Further, ve find Chat the relocation of Building A along the same 7.99-foot non-conforming side line setback as the existing Building K after Buildings K and L arc removed, does not make the non-conforming side line setback more non-conforming and in an open area this change is not more detrimental to the neighborhood. 4. Secondly, ve find under the request for variance relit[, that the severe and rapid erosion of the coastal bank in Siasconset, ._ --_ . .~ along the easterly sido of tho Deech Club property threatens the existing structures. Owing to the unique topography of this coastal bank location coupled with thn eroding soil conditions that does not generally affect tt~a LUC-] district in which this lot is located, a literal enforcement of the required 10-foot side and rear setback for lots oP record creates a substantial hardship. Since it 15 unknown how rapidly this erosion will continue, we find that it is important that the Beach Club be able to move the threatened structures as far west on the property as possible to avoid an annual need for relocation. Moreover, relief can be granted without substantial detriment to the neighborhood and without nullifying or substantially derogating.lrom the intEnt or purpose of the zoning by-law. 5. Accordingly, this Board by UNA1rIMOUS vote grants to the applicant 1) the requested special permit relief to generally, allow the relocation and removals of buildings on the Beach Club property and specifically, to allow the relocation of one (1) building at the same non-conforming side-line setback location as one of the removed buildings, and 2) the requested variance relief from Section 1]9-16A with respect to side and rear line setback requirements to allow one of the relocated existing structures to straddle the lot line.
