Applicant is seeking a SPECIAL PERMIT under Nantucket 7..oning By-Law §139-33A (alteratiar>/expansion of apre-existing, non-conforming use/structure). Applicant proposes to remove and/or demolish a said to be pre-existing two-family dwelling on the Locus, and to reconstruct and expand the two-family dwelling unit. The new structure would comply with all setback, grvund cover and parking requirements. The I.cx:us is nott- conforming as to lot size, having a lot area of 10,206± square feet in a district that requires a minimum lot sire of 20,000 square feet; as to front yard setback with the structure currently being sited about three (3) feet at its ctasest point from the front yard lot line along Western Avenue in a district that requires a minimum front yard setback of thirty (30) feet. The premises is located at 21 W1;S'1'IKN AVFNtJF, Assessor's Map 87, Parcel 97, Plan Book 67, Pagc 495, Lot 36+. The property is zoned Residential-2. 2. The Decision is based on the Application and materials submitted whit it and the testimony and evidence presented at the Hearing. The Planning Board made a negative recommendation stating that voluntary demolition and/or removal of stnrctures eliminates the non-conforming use cx;curring on the land, There was no other opposition tv this Application for relief. 3. Applicant proposes to remove the pre-existing, non-conforming duplex dwelling from the PKEMISES and to relocate it to other land, if feasible. In the alternative, Applicant proposes to demolish the existing duplex dwelling and to reconstruct a new duplex dwelling in its place on the Premises. Applicant, through counsel, stated that the pre-existing, non-conforn~ing duplex use of the dwelling has existed continuously on the Premises from 1946 [o date, thus the duplex use has "grandfathered" status. The Board takes notice of [ttc fact that the Deed to the Premises recorded in Book 387, Fage 20 at the Nantucket Registry of Deeds indicates that the Applicant has owned the property since 1963, twelve years prior to the enactment of [he Nantucket Zoning By-law. The proposed new duplex dwelling will have a ground cover of 1,472 square feet, less than the maximum ground cover allowable fur pre-existinfi, non-conforming lots held in non-contiguous ownership. Applicant, through counsel, represents to the Board that the new duplex dwelling will be winterized; the existing one is not. The BOARD finds that the Grant of a Special Permit to allow for the replacement of the pre-existing duplex dwelling with a new duplex dwelling is consistent with the purpose and intent of the Zoning By-law. The construction of a new duplex dwelling to replace the existing duplex dwelling on the Premises does not constitute an abandonment of the pre-existing, non-conforniing duplex use and the new duplex structure will not be substantially more detrimental to the neighborhood than the pre-existing duplex structure. The non-conforniing duplex use of the Premises remains unchanged irrespective of whether the pre-existing structure is removed, demolished or reconstructed, and SPRCiAi_ PERMIT Relief is appropriate in this case. Applicant proposes to move her pre-existing unwinterized duplex to another lot and replace it with a new winterized duplex constructed on the lot. The nonconforming duplex use will remain unchanged. The new duplex, unlike the present one, will have a conforming front- yard setback (30' required in this R-2 zone) and will have more than the 10' setback required from Western Avenue. As the 10,206 SF lot is undersized (20,000 SF required), the new duplex will have less than the allowed 1,500 SF ground cover. The two off street parking spaces required for a duplex will be provided. The sole remaining non-conformity is the continued duplex use where zoning allows asingle-family dwelling (optionally with secondary dwelling or accessory apartment). The continued duplex use, begun in 1946, and bringing the setback into zoning conformity, with no abandonment of the use, supports the findings needed for Special Permit relief, namely, that the proposed re-construction and extension of the existing duplex structure do not increase the nonconforming nature of the structure, are not substantially more detrimental to the neighborhood than the existing duplex use, and are in harmony with the general purpose and intent of the Zoning By-Law.
