NANTUCKET ZONING BOARD OF APPEALS
DECISION:
The Board of Appeals at a Public Hearing held on Friday, May 8,1998, at 1:00
p.m. and continued to Friday, June 12,1998, at 1:00 p.m. in the Town and County
Building at 37 Washington Street, Nantucket, Massachusetts, made the following
Decision on the application (048-98) of the S/J Wauwinet Trust, Steven S. Fischman and
Thomas J. Bloch, Trustees, of 115 and 120 Wauwinet Road, Nantucket, Massachusetts
02554.
1. Applicant is seeking a MODIFICATION of a SPECIAL PERMIT issued in
BOA File No. 021-87 in which relief was granted under Nantucket Zoning By-Law
Section 139-33A in order to permit the alteration of the pre-existing non-conforming
hotel use known as "The Wauwinet Inri' by allowing the dwellin known as "Idlewild"
to be rented as two (2) one (1) bedroom suites instead of a three (3~ bedroom cottage
with kitchenette, and substituting a new site plan so as to validate the construction of
sheds not shown on the original plan attached to the Decision granted in Board of
Appeals File No. 021-87. The kitchenette would be removed and there would be an
overall loss of one (1) bedroom in the subject structure.
Applicant also seeks a FINDING from the Board that interior renovations that do
not increase the use or expand the existing structure do not necessitate further zoning
relief from this Board. See also BOA File Nos. 095-86, 054-88, and 026-95.
The premises is located at 115 and 120 WAUWINET ROAD, Assessor's Map 11,
Parce117, Map 12, Parcel 46 and Map 12, Parcel 47, Land Court Plans No.15598-A, Lot
B, 15961-D, Lot 32 and 15961-K, Lot 56. The property is zoned Residential-1.
2. The Board's decision is based upon the application and materials
submitted with it, plans, and representations and testimony received at the hearing on
May 8,1998, and June 12,1998. There were eleven (11) letters in opposition to the
requested Modification of a Special Permit relief, one (1) letter from the attorney for the
Wauwinet Homeowners' Association, and one (1) letter from an engineer retained by
the Wauwinet Homeowners' Association, in opposition to the requested Modification
of a Special Permit relief. Several abutters were present to speak to concerns and in
opposition at both hearings. The Planning Board made no recommendation, finding
that the requested relief did not involve planning issues. At the request of the abutters,
the Applicant held an informal site visit on the Premises on June 9,1998. The Board's
administrator, several members of the Board, abutters and their representatives, and
Applicant's counsel were allowed to attended the site visit. No testimony on the
application was taken at the site visit.
3. The Premises known as "The Wauwinet" is a resort hotel consisting of the
main inn building which contains twenty-six (26) guest rooms and other uses, five (5)
rental buildings, and customary and reasonable activities and uses of a resort hotel. The
Applicant's commercial use of the Premises as a hotel and rental buildings in the
Residential-1 zone is apre-existing non-conforming use, continuous since a time prior
to 1972. The lot and structures on the Premises conform with all of the dimensional
requirements of the Residential-1 zone.
4. As a matter of jurisdiction, the Board considered whether the Applicant
fell within the definition of a "Major Commercial Development" (MCD) pursuant to
Nantucket Zoning By-law Section 139-11, in which case the relief sought in the
application would be properly before the Nantucket Planning Board.
5. After reviewing information provided by the Applicant and abutters, the
Board finds that since the adoption of MCD regulations on April 4,1979, the Ap licant
has not met or exceeded any of the MDC thresholds set forth in section 139-11(B~of the
Nantucket Zoning By-law. The relief requested in this application will not change the
footprint of any structure, increase parking requirements, nor increase the number of
rental units on the Premises.
6. The Applicant requests a modification of the Special Permit relief granted
by the Nantucket Zoning Board of Appeals in File No. 021-87, which authorized a major
renovation of the main inn and rental buildings. Among other things, in addition to the
main inn building the Decision permitted the Applicant to maintain five (5) separate
buildings as rental units, of which three (3) buildings would house seven (7) "hotel
units and two (2) buildings would be rental cottages, for a total of nine (9) separate
rental units.
7. The Applicant proposes to alter the rental building known as "Idlewild"
from a three (3) bedroom building with a kitchenette to two (2) one-bedroom hotel
units. The proposed alteration will reduce the number of bedrooms from three (3) to
two (2), thereby decreasing the occupancy of the building from six (6) people to four (4)
people. The kitchenette will be removed. The Applicant maintains only seven (7) other
rental units among the four (4) other rental buildings, so the pro osed alteration will
not increase the number of separate rental units from the nine (9~units allowed under
the 1987 Special Permit.
8. At the hearing, abutters spoke in opposition to the Applicant's request for
a FINDING that interior renovations that do not increase the use or expand the existing
structures do not necessitate further zoning relief from this Board. The Nantucket
Building Inspector and Zoning Enforcement Officer stated that, notwithstanding any
such finding by this Board, he would review any application for a building permit from
the Applicant and make an independent judgment whether the work requested in the
application necessitated Board of Appeals relief. The Board found that future plans for
interior renovations and minor changes should be submitted to the Zoning Enforcement
Officer for his decision whether zoning relief would be required. Thereupon, the
Applicant WITHDREW its request for a FINDING that interior renovations that do not
increase the use or expand the existing structures do not necessitate further zoning
relief, which WITHDRAWAL the Board voted unanimously to accept WITHOUT
PREJUDICE.

9. The Applicant also seeks review and approval of a current site plan of the
Premises, consisting of two sheets, the first sheet entitled "Site Plan of Land of The
Wauwinet Inri' and the second sheet entitled "Site Plan Showing Existing Pier & Dock
Locations at The Wauwinet House Hotel," registered by Blackwell and Associates,
Professional Land Surveyors, Sheet One dated January 3,1996, revised June 11,1998,
and Sheet Two dated June 11,1998, and submitted to the Board at the public hearing on
June 12,1998. The Applicant requests that the Board of Appeals ratify and confirm the
~lans to validate the three (3) existing shed structures, shown as "Shed A=120 s.f.±,"
'Maintenance Shed A=292 s.f.±~" and "Shed A=94 s.f.+" and their uses for ancillary
hotel support, maintenance, storage and landscaping on the Premises.
10. With respect to the Apppplicant's request for a Modification of a Special
Permit for the alteration of "Idlewild," the Board finds that the alteration of "Idlewild"
from a three (3) bedroom building with a kitchenette to two (2) one-bedroom hotel units
will decrease the intensity of the use of the building. Therefore, the Board finds that the
requested relief will not be substantially more detrimental to the neighborhood than the
existing nonconforming use. Since the Applicant will continue to operate a total of nine
(9) units among the five (5) rental buildings, the Board finds that the requested relief is
in keeping with the pre-existing non-conforming use and with prior relief granted by
this Board.
11. With respect to the Applicant's site plan and the three (3) sheds, the Board
finds that the existence of the three~3) sheds and their use for ancillary hotel support,
light maintenance, storage, and lan scaping does not alter or extend the primary use, is
consistent with the pre-existing non-conforming use, and is not substantially more
detrimental to the neighborhood.
12. Accordingly, by a unanimous vote, the Board hereby GRANTS the
MODIFICATION of SPECIAL PERMIT Relief to permit the alteration of "Idlewild"
from a three (3) bedroom building with a kitchenette to two (2) one-bedroom hotel units
with the kitchenette removed and to APPROVE the current SITE PLAN by Blackwell
and Associates, Surveyors, consisting of two the first sheet entitled "Site Plan of Land of
The Wauwinet Inn' and the second sheet entitled "Site Plan Showing Existing Pier &
Dock Locations at The Wauwinet House Hotel," registered by Blackwell and Associates,
Professional Land Surveyors, Sheet One dated January 3,1996, revised June 11,1998,
and Sheet Two dated June 11,1998, and ate the existenc¢ and use of the three (3)

ADDENDUM TO THE APPLICATION OF
S/J WAUWINET TRUST
THE WAUWINET, WAUWINET ROAD, NANTUCKET
The Applicants seek a modification of Special Permit 021-87 (registered as
Document No. 39521 at the Nantucket Registry District) under Section 139-33A so as to
permit the alteration of the pre-existing nonconforming hotel use known as The
Wauwinet Inn by (1) allowing the cottage known as Idlewild to be rented as two one-
bedroom suites instead of athree-bedroom cottage with kitchenette, and (2)
substituting the attached site plan as a new Exhibit A so as to validate the construction
of sheds not shown on the plan attached as Exhibit A to Special Permit 021-87. The
prior relief granted by the Board in Special Permit 021-87 permitted, in addition to the
uses within the main hotel structure, outlying buildings housing seven hotel units and
two rental cottages. As a result of this modification request, one of what is described in
Special Permit 021-87 as the "rental cottages" would be used as two hotel suites (with a
loss of one bedroom and a kitchen). As currently utilized, the outlying cottages
adjacent to Idlewild contain six hotel units, instead of the seven permitted under the
Special Permit. Accordingly, there is no increase in the number of rented units beyond
the number of units permitted by Special Permit 021-87.
The applicants also request a finding from the Board that interior renovations
that do not increase the use (such as the reconfiguration of guest rooms, the renovation
of restroom, storage or kitchen facilities, or the alteration of employee and hotel support
facilities) or expand the existing structures do not necessitate further zoning relief.
The Major Commercial Development thresholds of Section 139-11 will not be
triggered by this modification. The Zoning Board of Appeals is the appropriate Special
Permit Granting Authority for this application.
With respect to the parking requirements of Section 139-18, the Board's decision
in its Case No. 021-87 stated that the parking lot is not fully subject to the parking
requirements in the By-law, because of the prior nonconforming status of the structures
and use. The modification requested does not trigger additional parking requirements.
The proposed modification is in keeping with the pre-existing nonconforming
use anti structures, as well as the prior relief granted by the Board. Nothing requested
hereby will be detrimental to the neighborhood or is inconsistent with the general
purpose and intent of the zoning by-law.
