Applicant is seeking a SPECIAL PERMIT under Nantucket Zoning By-Law §139-16C(2) to validate a said to be unintentional setback intrusion of a first and second floor deck, attached to a single-family dwelling, and solar energy facility, all of which were said to have been constructed in 1979. The decks are sited 8.5+ feet at their closest points from the southerly side yard lot line in a district that requires a minimum of ten (10) feet for this lot and the solar energy shed is sited about five (5) feet at its closest point from that lot line. The Premises is located at 42 WIGWAM ROAD, Assessor's Map 77, Parcel 8.1, Land Court Plan 5004-50, Lot 812. The property is zoned Limited-Use-General-3. 2. The Decision is based upon the Application and the materials submitted with it, and the testimony and evidence presented at the Hearing. The Planning Board made no recommendation as the matter was not of planning concern. There were no letters in the file. 3. Applicant, through counsel, represented, through submission of an "Affidavit" from the predecessor-in-title, that he purchased the property in 1986 and that said owner had constructed the two-story 748± square-foot single-family dwelling and 200+ square-foot solar energy facility in 1979 under a duly issued Building Permit, with a Certificate of Occupancy having been issued in 1981. The original first and second floor decks were 8' x 12' as shown on the 1979 Historic District Commission approved plans. On or about 1990, a caretaker reconstructed the first floor deck on the same footprint and extended the second floor deck in a westerly direction along the entire length of the south side of the dwelling without the necessary permits and a Notice of Violation was issued. The addition to the second floor deck mets the required 10-foot side yard setback distance as shown on a plan dated April 4, 1998, done by Charles W. Hart & Associates, Inc. The solar energy facility was needed in 1979 as utilities were not available to the site. Applicant further represented that all of the solar energy materials were still retained in the structure, although it was not currently activated, with electrical service now connected to the site. 4. Therefore, the Board finds that a Special Permit may be granted to validate the unintentional intrusion of the first and second floor decks, which are located not greater than five (5) feet into a required yard and not closer than four (4) feet from a lot line, as shown upon a plan, dated April 2, 1998, done by Charles W. Hart & Associates, Inc., marked as Exhibit A and attached hereto. The burden of correcting the intrusion substantially outweighs any benefit to an abutter, being unimproved land owned by the Nantucket Conservation Foundation, Inc., of eliminating the intrusion. The Board further finds that the intruding structure was so sited prior to 1990 and does not require siting to be based upon a licensed survey to benefit from relief under Zoning By-Law §139-16C(2). The Board, however, did not find any mitigating factors that would support a grant of relief to validate the intrusion of the solar energy facility into the southerly side yard setback. The Board finds that the removal, re-siting or demolition of the structure would not constitute a burden upon the Applicant. 5. Accordingly, the Board, by a unanimous vote, GRANTS the requested SPECIAL PERMIT under Nantucket Zoning By-Law §139-16C(2) to validate the current siting of the first and second floor decks only, on the southerly side of the single-family dwelling upon the following conditions: a. There shall be no further construction, other than for repairs and maintenance to said dwelling and decks, within the 10-foot southerly side yard setback area, without further relief from this Board; and b. The solar energy facility shall be removed, demolished or made conforming as to setbacks, within one (1) year from the date of the filing of this Decision with the erk of Nantucke . The second floor portion of the deck is an integral pars of the construction of the house and the burden of correciino the intrusion outweighs any benefit to an abutter of eliminating the intrusion. The first and second floor decks on the southerly side of the house were originally 8 ' x 12' as shown on the 1979 HDC approved plans. On or about 1990, a caretaker reconstructed the deck, but extended the second floor deck along the length of the south side of the house without the necessary permits and a Notice of Violation was issued. The "new" portion of the deck meets the required ten (10') foot set back as shown on the plan. The solar energy facility was constructed in 1979 with the house when utilities were not available to the site. All of the solar energy materials are still retained in the facility. (2) to validate an unintentional set back intrusion of a first and second floor deck and a solar energy facility which were constructed in 1979 and are located not greater than five (5') feet into the required sideyard set back of ten (10'} feet and not closer than four (4') feet from the lot line. Tf.e second floor portion of the deck is an integral part of the construction of the house and the burden of correcting the intrusion outweiahs any benefit to an abutter of eliminating the intrusion. The first and second floor decks on the southerly side of the house were originally 8 ' x 12' as shown on the 1979 HDC approved plans. On or about 1990, a caretaker reconstructed the deck, but extended the second floor deck along the length of the south side of the house without the necessary permits and a Notice of Violation was issued. The "new" portion of the deck meets the required ten (10') foot set back as shown on the plan. The solar energy facility was constructed in 1979 with the house when utilities were not available to the site. All of the solar energy materials are still retained in the facility.
