At a Public Hearing of the Nantucket Board of Appeals held at 1:00
P.M., Friday, April 10, 1998, in the Conference Room, Town Annex
Building, 37 Washington Street, Nantucket, Massachusetts, on the
Application of ZAHARIAS AND WALTRUD KARYOTAKIS, of 13 Old South Road,
Nantucket, MA 02554, Board of Appeals File No. 044-98, the Board made the
following Decision:
1. Applicants are seeking a SPECIAL PERMIT under Nantucket Zoning
By-Law §139-33A (alteration/expansion of a pre-existing non-conforming
structure/use). Applicants propose to alter and expand a garage structure
that is sited 8.4+ feet at its closest point from the southwesterly side
yard lot line rather than the required ten (10) feet, by adding a second
floor and converting the use to a secondary dwelling unit. The addition
would come no closer to that side yard lot line than the existing
structure and a proposed addition on the southeasterly side of the
structure would be in conformance with setback requirements. The
principal dwelling is non-conforming as it is sited 8.0+ feet at its
closest point from the southwesterly side yard lot line and 19.3+ feet
at its closest point from the front yard lot line along Fairgrounds Road,
in a district that requires a ten-foot side and rear yard setback and a
front yard setback of 20 feet.
The premises is located at 1 FAIRGROUNDS ROAD, Assessor's Map 55,
Parcel 70, Plan Book 23, Page 86, Lot 5. The property is zoned
Residential-10.
2. The Decision is based upon the Application and the materials
submitted with it and the testimony and evidence submitted at the
Hearing. The Planning Board made no recommendation as the matter was not
of planning concern. There were no letters on file.
3. Applicants represented that they wished to covert an existing
garage structure, that was in need of substantial repair, into a
secondary dwelling. A second-floor addition would be constructed that
would increase the height of the structure within the 10-foot side yard
setback area but come no closer to that lot line than the existing
structure. An addition on the southeasterly side of the structure would
be built outside of the required setback areas. Applicants presented
evidence; including a letter from the son of the previous owner of the
property, that the structure pre-dated the 1972 enactment of the
Nantucket Zoning By-Law. Two (2) parking space would be provided to meet
the requirement of one (1) parking space per dwelling unit, with the Lot
also containing a primary single-family dwelling unit.
4. Therefore, the Board finds that the alteration and extension of
the garage structure, by changing the use to a secondary dwelling unit,
and allowing upward expansion of the structure within the required
southwesterly side yard setback area without coming any closer to that
lot line, would not be substantially more detrimental to the neighborhood
than the existing use and structure.
5. Accordingly, by a unanimous vote, the Board GRANTS the requested
relief by SPECISL PERMIT under Nantucket Zoning By-Law §139-33A to allow
the expansion as proposed above, under the following conditions:
a. Construction shall be in substantial conformance with the
Certificate of Appropriateness No. 31,599 issued by the Nantucket
Historic District Commission; and
b. The additions shall be in substantial conformance with the
plan done by Robert Emack of Emack Surveying, dated March 10, 1998,
marked as Exhibit A and attached hereto.
