Applicant (Conti) is seeking a SPECIAL PERMIT under Nantucket Zoning By-Law §139-9B(2)(o) to convert existing 977+ square feet of retail space to a take-out food establishment. The Locus is non-conforming as to lot area, having an area of 2,723+ square feet in a district that requires a minimum lot area of 5,000 square feet; as to side and rear yard setbacks, with the structure being sited 2.24+ feet at its closest point from the northerly side yard lot line along Old North Wharf, and zero feet from the rear yard lot line in a district that requires a minimum side and rear yard setback of five (5) feet; as to ground cover with the Locus having a ground cover ratio of 35+% in a district that requires a maximum ratio of 30% for undersized lots; and as to parking and loading zone requirements. In addition, to the extent necessary, Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-Law §139-18 (Parking Requirements) and §139-20C (loading zone requirement). The new use would requires seven (7) parking spaces, with three (3) spaces provided. The premises is located at 4 EASY STREET, Assessor's Map 42.3.1, Parcels 79 and 79.1, Land Court Plan 3745-B, Lot 2 and Land Court Plan 8544-B, Lots 1 and 2. The property is zoned Residential-Commercial. 2. The Decision is based upon the Application and the materials submitted with it and the testimony and evidence presented at the Hearing. The Planning Board made a favorable recommendation on the condition that the Applicant provide and maintain two (2) trash receptacles, one (1) at each of the property's corners along Easy Street. There was one (1) letter from an area business owner in favor of the Application and a petition, signed by 23 area residents, business owners and abutters, supporting the grant of relief as a welcome addition. to the neighborhood. 3. Applicant, through counsel, represented that the Lot and structure were pre-existing and non-conforming, existing from a time prior to the effective date of the Zoning By-Law in 1972, and used continuously to the present for commercial purposes. The Applicant proposes to lease the property from the Owner, Fawn Grove Realty Trust, and convert the existing first-floor retail liquor store to a juice bar for take-out non-alcoholic beverages, with one (1) take-out station and up to four (4) employees on the premises at peak shift. The structure also contains a second-floor office and storage area. Applicant submitted a Site Plan, prepared by Blackwell and Associates, Inc., dated March 9, 1998, showing three (3) on-site parking spaces that would be maintained after conversion. The new use would require nine (9) off-street parking spaces: five (5) for the take-out station, one (1) space for employees, and three (3) spaces for the second floor office/storage use. In response to Board concern about possible use of a portion of the second floor space as a dwelling unit, the Applicant agreed, in the event of such conversion of space, to make the unit comply with current Building Code requirements. Applicant further represented that there would be no cooking on site nor hot food prep or sandwiches offered. 4. Therefore, the Board finds that a grant of Special Permit relief to convert the subject space from a retail liquor store to a take-out food establishment, without expanding the existing footprint, would be in harmony with the. general purposes and intent of the Zoning By-Law and would not be detrimental to the neighborhood than the existing use. As to parking and loading zone relief, the Board finds that a grant of the requested Special Permits would be in harmony with the general purposes and intent of the Zoning By-Law and would not be contrary to sound traffic and safety considerations with the spaces and zone being physically impossible to provide on-site, aside from the three (3) existing on-site parking spaces. The Board notes that the Locus is located within the dawn-Town commercial area where most existing properties exceed maximum thresholds and provide no on-site parking or loading facilities, further noting that there are on-street designated loading zones proximate the property from which deliveries can be made. 5. Accordingly, the Board, by a unanimous vote, GRANTS the requested SPECIAL PERMIT under Nantucket Zoning By-Law §139-9B(2)(o) to convert 977+ square feet of first-floor space from retail to a take-out food establishment serving non-alcoholic beverages, with one (1) station and up to four (4) employees on-site at peak shift, and GRANTS a SPECIAL PERMIT under Nantucket Zoning By-Law §139-18, waiving six (6) required parking spaces and under Nantucket Zoning By-Law §139-20C waiving the loading zone requirement, upon the following conditions: a. Applicant shall continue to provide and maintain three (3) parking spaces on-site for use by patrons and which shall not be used by employees; b. Applicant shall provide two (2) trash receptacles, one (1) at each corner of the premises at Easy Street; c. There shall be no cooking of hot foods upon the premises nor on-site cooking or sandwiches offered; and d. Should the second-floor space, or a portion thereof, be converted to a dwelling unit use, the space shall comply with all current applicable Building Code requirements pertaining to said use. The Premises are located at 4 Easy Street and include three (3) on-site parking spaces. The Premises has been used as a retail liquor store and other commercial uses continuously from a time prior to the effective date of the Nantucket Zoning By-law in 1972 to the present day. The Premises have an aggregate area of approximately 2...723± square feet and the building on the Premises includes a first floor retail Liquor store and a second floor office and storage area. The Premises are non-conforming as to zoning intensity regulations, off-street parking requirements, and off-street loading requirements; however, all such zoning non-conformities have existed prior to the effective date of the Nantucket Zoning By-law and constitute protected, pre-existing non-conformities. The Applicant proposes to convert the first floor retail liquor store on the Premises to a take-out food establishment which will serve non-alcoholic juice drinks and uther refreshments. For this proposed use, seven (7) off-street parking spaces are required: five (5) spaces for the take-out station, one (1) space for employees, and one (1) space for the second floor office use. Three (3) off-street spaces are provided on the Premises and four (4) spaces are "grandfathered". The required off-street loading facility requirement is also "grandfathered". In the event that the four (4,1 off-street parking spaces and the loading facility are deemed. to be required, then, in that event, ti`te Applicant seeks a waiver from these requirements. The Applicatt also states that no Site Plan Review is required pursuant to Section 139-23B of the By-law because the proposed change of use of the Premises from a retail liquor store to a take-out juice bar is exempt from site plan review requirements because there will be no increase in the intensification of use (139-23C(3)) and the proposed change of use will have no effect on the foot print of the 4 Easy Street building nor add off-street parking (139-23C(4)).
